Off-Plan Property: UAE Tax Implications

Buying off-plan in Dubai? VAT, DLD fees, escrow protection and when flipping off-plan units triggers UAE corporate tax - explained for buyers.

off plan property tax dubai

Buying off-plan in the UAE carries no personal income tax, no capital gains tax and no VAT sting for most individual buyers, since the first supply of a new residential building is zero-rated. The costs to budget are the Dubai Land Department transfer fee of 4% on registration, Oqood fees, and service charges after handover. Flipping off-plan units before completion can recharacterise you as a trader for corporate tax.

# VAT: the first supply is zero-rated

A typical off-plan apartment bought from a developer is the first supply of a new residential building, which the VAT law zero-rates at 0%. In plain terms, no VAT is added to the purchase price and the developer recovers their own VAT through the zero-rating. This is one reason off-plan prices can look keener than resales on a like-for-like basis. The position only changes for commercial off-plan units, where the sale is standard-rated at 5%. Individual buyers of residential off-plan therefore have no VAT registration or filing obligation arising from the purchase. Keep the reservation form, sales purchase agreement and every payment receipt, because they establish your cost base and the zero-rated nature of the supply if anything is ever queried.

# Transfer fees, Oqood and escrow: the real costs

The real costs of an off-plan purchase are administrative rather than fiscal. Dubai levies a 4% transfer fee on the purchase price when the transaction is registered, plus Oqood interim registration fees and smaller administrative charges. All-in, budget around 5% above the headline price. Your stage payments go into an escrow account under Dubai Law No. 8 of 2007, which ring-fences buyer funds for construction of that project. Escrow is a consumer-protection measure, not a tax matter, but it interacts with tax planning in one useful way: the payment schedule and escrow statements create a clean audit trail of your cost base. Service charges start only after handover, so there is no annual holding tax to budget during construction. If the developer delays, your contractual remedies sit in the sale agreement, not the tax code.

# Selling or assigning before handover

Many off-plan buyers never intend to take handover; they assign the contract at a profit before completion. A single assignment is an investment disposal and attracts no UAE tax on the gain. A pattern of assignments is a different story. Buying multiple off-plan units with the intention of flipping them shows the classic badges of trade: short holding periods, profit motive at purchase, and marketing of the units. If the activity amounts to a business and turnover, meaning gross assignment proceeds, exceeds AED 1,000,000 in a calendar year, corporate tax registration becomes mandatory and profits are taxed at 0% up to AED 375,000 and 9% above. Each assignment also incurs transfer and administrative fees that compress margins. If your plan involves more than one off-plan purchase a year, structure it deliberately and take advice before you sign the second reservation form.

How assignments work

An assignment transfers your buyer position to a new purchaser with the developer's consent and usually a no-objection certificate. The developer may charge an assignment fee, and the Land Department registers the transfer. Economically it is a sale of your contractual rights, and the tax analysis follows the trading-versus-investing distinction.

# Mistakes off-plan buyers keep making

Off-plan investors make three recurring mistakes. The first is forgetting the 4% transfer fee in yield calculations, which turns a thin projected gain into a loss. The second is assuming VAT applies to the purchase and either overpaying or misclaiming; residential off-plan from a developer is zero-rated, not exempt and not standard-rated, and the distinction matters for developers more than buyers. The third is serial flipping without tracking turnover against the AED 1,000,000 corporate tax threshold. A disciplined buyer registers the purchase properly, keeps every payment document, budgets the full frictional cost, and decides at purchase whether the unit is a hold-to-let investment or a trade, because that intention shapes everything that follows.

Decide your strategy at purchase

Document your intention at purchase with a dated note or message stating whether the unit is for letting, own use or resale. If the FTA ever examines a pattern of assignments, contemporaneous evidence of original intent is far more persuasive than after-the-fact explanations.

# Financing an off-plan purchase

Most UAE banks lend against off-plan units only for approved projects and developers, usually at lower loan-to-value ratios than completed property. Interest during construction is generally not deductible for an individual buyer, since there is no taxable income to offset it against unless the activity is a corporate-tax business. If you later let the unit, the mortgage interest becomes part of your financing-cost records for the rental computation. Buyers using payment plans directly with the developer should confirm whether the plan includes any administration charges that function like interest, and keep the full payment schedule with the purchase file.

FAQ Answers to the questions people actually ask

Frequently asked questions

Is profit on off-plan property taxed in the UAE?

No. Individuals pay no capital gains tax on UAE property, including off-plan units. If you assign or sell the unit before completion at a profit, the gain itself is not taxed in the UAE, though frequent flipping can trigger the corporate tax business rules.

Do I pay VAT on off-plan property in Dubai?

The first supply of a new residential building is zero-rated at 0%, so no VAT is added to the price of a typical off-plan apartment bought from a developer. Later resales of residential property are exempt.

What fees apply when buying off-plan in Dubai?

Dubai charges a 4% transfer fee on the purchase price when the off-plan sale is registered, plus Oqood registration and administrative fees. These are transaction costs, not taxes, but budget around 5% all-in on top of the price.

Can flipping off-plan units trigger corporate tax?

Possibly. Assigning contracts or flipping several off-plan units for profit shows the badges of trade, and if the activity is a business with turnover above AED 1,000,000 in a calendar year, corporate tax registration is required.
