No capital gains tax for individuals in the UAE
# The headline: no personal income tax on rent
A UAE resident landlord faces no personal income tax on rent, no matter how many properties they own or how much rent they collect. The Emirates has never introduced a personal income tax, and rental receipts arrive in full. There is also no annual property tax and no wealth tax on the portfolio itself. The only taxes that can touch rental income are corporate tax, in narrow business cases, and VAT, on commercial lets. This simplicity is deliberate: the UAE competes for mobile capital by keeping the holding costs of property close to zero. The trade-off is that the few thresholds that do exist are strictly enforced, with penalties for late registration that can dwarf the tax itself. Understanding where those lines sit is the whole of landlord tax planning in the UAE.
# When rental income can attract corporate tax
Corporate tax reaches individual landlords only through the natural-person business route. Under Federal Decree-Law No. 47 of 2022 and Cabinet Decision No. 49 of 2023, a resident natural person is subject to corporate tax if they conduct a business or business activity in the UAE and their turnover from it exceeds AED 1,000,000 in a calendar year. Letting one or two properties on standard annual tenancies is normally passive investment, not a business. Running many units, offering serviced or short-term lets with hotel-style services, or employing staff to manage the portfolio points toward business status. Cross the threshold and you must register with the FTA on EmaraTax, keep proper books and file an annual return. Taxable income is then taxed at 0% up to AED 375,000 and 9% above, after deductible expenses such as service charges, maintenance, agency fees and financing costs. Fall below the threshold and none of this applies, even if you technically operate as a business.
Measuring the AED 1,000,000 turnover test
Add up gross rents across all UAE properties for the calendar year. Service charges and agency fees do not reduce turnover for threshold purposes; the test is on gross receipts. Track it monthly so a strong year does not surprise you in January.
# VAT on residential rent is exempt, commercial rent is not
VAT follows the property, not the landlord. Leasing residential property is an exempt supply, so a resident landlord charges no VAT on a standard twelve-month tenancy and files no VAT return for it. Leasing commercial property is standard-rated at 5%: once your taxable supplies exceed AED 375,000 in the previous twelve months, VAT registration becomes mandatory, and you can register voluntarily from AED 187,500. Mixed portfolios need care. A landlord with exempt residential flats and one standard-rated office must apportion input VAT and can only recover VAT on costs linked to the taxable activity. Short-term holiday lets are generally treated as standard-rated supplies, closer to hotel accommodation than to a residential lease. Getting the classification wrong in either direction costs money, so confirm it before you start hosting.
| Supply | VAT treatment | Rate |
|---|---|---|
| Residential lease (long term) | Exempt | 0% — no VAT charged |
| Commercial lease | Standard-rated | 5% |
| Short-term holiday let | Standard-rated | 5% |
| Residential property management fee charged to you | Standard-rated input | 5% VAT you bear |
# Selling a rental property: what changes
Selling a rental property changes nothing about income tax, because individuals pay no capital gains tax on UAE property disposals. The costs of sale are transactional: Dubai Land Department charges a 4% transfer fee on the sale price plus administrative fees, and the sale contract decides whether buyer or seller bears it. Agency commission, typically around 2%, is a commercial cost rather than a tax. If you sell so frequently that the FTA views you as trading in property, the profits can fall into the corporate tax net under the natural-person business rules, with the same AED 1,000,000 turnover threshold. For the occasional sale of a long-held rental, no tax registration is triggered by the disposal itself. Keep the original purchase contract, transfer documents and improvement invoices indefinitely; they prove your cost base if the activity is ever recharacterised as a business.

Frequently asked questions
Is rental income taxable for UAE residents?
No. The UAE has no personal income tax, so residents pay zero UAE tax on rental income from local property. Corporate tax can apply only if the rental activity is a business with turnover above AED 1,000,000 in a calendar year.
Do I charge VAT on rent in the UAE?
Generally no. Residential rent is an exempt supply under the UAE VAT law, so landlords charge no VAT on standard tenancies. Commercial rent is standard-rated at 5%, and landlords must register for VAT once taxable supplies exceed AED 375,000 in twelve months.
Do landlords need corporate tax registration in the UAE?
Not automatically. You must register for corporate tax only if your rental activity is a business and turnover exceeds AED 1,000,000 in a calendar year. Most residents letting one or two flats stay below this line and need no registration.
Is there capital gains tax on selling a rental property?
No. Individuals pay no capital gains tax on UAE property sales. The main transaction cost is the Dubai Land Department transfer fee of 4% of the sale price, plus administrative fees, allocated between buyer and seller in the sale contract.
