Input Tax Recovery for Real Estate in the UAE

How real estate businesses recover input VAT in the UAE: what is recoverable, what is blocked, apportionment, and the Capital Asset Scheme.

vat on real estate uae

Real estate is taxed by the character of the supply, not by the person making it. This page explains when property developers, landlords, brokers and facility managers recover input VAT in the UAE: what is recoverable, what is blocked, how mixed businesses apportion under Article 55, and how the Capital Asset Scheme tracks large assets.

Basis: Federal Tax Authority

General recovery rule
Recoverable where used for taxable supplies

Federal Decree-Law No. 8 of 2017

Zero-rated outputs
Full recovery; zero-rated is taxable

Article 45, Federal Decree-Law No. 8 of 2017

Exempt outputs
Recovery blocked

Article 46, Federal Decree-Law No. 8 of 2017

Mixed supplies
Apportion under Article 55

Article 55, the VAT Executive Regulation

Capital assets

Capital Asset Scheme, the VAT Executive Regulation

# When real estate input tax is recoverable

Real estate is where input tax recovery stops being arithmetic. A developer building residential stock to sell within the three-year window is making zero-rated supplies and recovers in full. The same developer holding the stock and letting it after the first supply is making exempt supplies and recovers nothing on those costs. Mixed-use schemes do both at once. The general rule is simple: VAT incurred on goods and services used for making taxable supplies, which includes zero-rated supplies, is recoverable as input tax. Full recovery on costs behind zero-rated first supplies of residential buildings, and on costs behind standard-rated commercial supplies. No recovery on costs behind exempt residential resales and exempt bare land sales; that VAT is a transaction cost.

# Blocked input tax in real estate

Some VAT can never be recovered, whatever the outputs: entertainment, most motor vehicles, and goods or services for private or non-business use are blocked by the legislation. Beyond those, recovery follows the outputs, as the table shows.

# Apportionment for mixed real estate supplies

Where a business makes both taxable and exempt supplies, Article 55 of the VAT Executive Regulation requires residual input tax to be apportioned: a recovery percentage computed on input tax, rounded to a whole number, with an annual wash-up once the year's actual mix is known. In real estate, the shared costs are typically apportionment under article 55 of the executive regulation for residual costs of mixed-use developments, computed on input tax and rounded to a whole number, with an annual wash-up. The percentage is computed on input tax, not on turnover, rounded to a whole number, and trued up annually once the year's actual taxable-exempt mix is known.

# The Capital Asset Scheme in real estate

The Capital Asset Scheme monitors large assets over several years. A single item of expenditure of AED 5,000,000 or more on a building is monitored over ten consecutive years, with the input tax adjusted where the taxable use changes; other qualifying assets are monitored over five years. A capital asset register must be kept from the first year. For property developers, landlords, brokers and facility managers, the assets that typically fall in are buildings and major fit-out. A use change, such as a building moving from taxable to exempt letting, triggers an adjustment; without the register, the adjustment cannot be calculated or defended.

# Evidence and timing: claiming it right

Input tax is claimed on the VAT return for the tax period in which the conditions are met, with a valid tax invoice or import documentation held. Article 52(4) of the Executive Regulation: where the first supply of a residential building is a zero-rated lease, input tax is recoverable in full on that supply regardless of any later intention to make exempt supplies. Buildings fall into the Capital Asset Scheme: a single item of expenditure of AED 5,000,000 or more on a building, monitored and adjusted over ten consecutive years, with a capital asset register kept from year one. VAT records must generally be kept for five years after the end of the tax period they relate to, and longer for specific categories such as real estate records. Invoices, contracts, import and export evidence, and the workings behind apportionment all sit inside that file.

# Pre-registration and post-deregistration input tax

VAT incurred before registration on goods and services acquired for the business can be recovered subject to the statutory conditions and time limits, which matters for property developers, landlords, brokers and facility managers with heavy set-up spending. After deregistration, remaining stock and assets may trigger adjustments, and the Capital Asset Scheme can continue to bite after the TRN is cancelled. Plan the entry and the exit with the same care: the recovery position at the start and the adjustments at the end are both part of the same calculation.

# Bad debts and adjustments in real estate

Where a customer never pays, the VAT legislation provides bad-debt relief subject to conditions, allowing the output tax to be adjusted; the conditions and time limits must be met and evidenced. Price adjustments after the supply need credit or debit notes that flow through to the tax of the period. For property developers, landlords, brokers and facility managers, systematic adjustment routines matter more than individual corrections: the return should reflect the ledger, and the ledger should reflect the documents.

FAQ Answers to the questions people actually ask

Frequently asked questions

Can property developers, landlords, brokers and facility managers recover VAT on purchases?

Where the purchases are used for making taxable supplies, yes, in full: zero-rated supplies count as taxable. VAT on costs behind exempt supplies is blocked, and shared costs are apportioned under Article 55 of the Executive Regulation.

What input tax is always blocked?

Entertainment, most motor vehicles, and goods or services for private or non-business use are blocked by the legislation regardless of the business's outputs. Beyond those categories, recovery follows the use of the purchase.

Does a landlord need to register for VAT on residential rental income?

Not on exempt residential rent alone, because exempt supplies do not count toward the registration threshold. But any standard-rated income, such as commercial units or service charges, counts in full, and imported services received also count toward the threshold.

How does apportionment work?

Residual input tax is split by a recovery percentage computed on input tax and rounded to a whole number, under Article 55 of the Executive Regulation, with an annual wash-up once the year's actual mix of taxable and exempt supplies is known.

What is the Capital Asset Scheme?

Large assets are monitored for several years: buildings costing AED 5,000,000 or more over ten years, other qualifying assets over five years, with input tax adjusted if the taxable use changes. A capital asset register must be kept.
