foreign tax credit uae corporate tax
A UAE taxable person that paid foreign tax on income also taxable in the UAE can claim a foreign tax credit on the corporate tax return, reducing the UAE liability. The credit is limited to the UAE tax attributable to the foreign income; it cannot create a refund of UAE tax or exceed the foreign tax actually paid.

# How the credit works
Double taxation is relieved by giving credit for the foreign tax against the UAE tax on the same income. Compute the UAE tax attributable to each foreign income stream, compare it with the foreign tax paid on that stream, and claim the lower of the two. The comparison is done per stream or country as the rules require, not as a single global pool, so keep the income streams separate in the workings.
The credit only helps where there is UAE tax to relieve. Foreign income sheltered by the participation exemption or another exemption generates no UAE tax, so there is nothing to credit against. And where the foreign tax exceeds the UAE tax on the stream, the excess is simply lost; it cannot be refunded or carried forward. This makes the timing of foreign income against UAE losses a real planning point.
| Item | Amount (AED) |
|---|---|
| Foreign dividend income | 1,000,000 |
| Foreign withholding tax paid (15%) | 150,000 |
| UAE tax on that income at 9% | 90,000 |
| Credit claimable (lower) | 90,000 |
| Excess foreign tax (lost) | 60,000 |
# Documentation the FTA expects
For each credit claim, keep the foreign tax proof: withholding tax certificates from the payer, foreign tax assessments, payment receipts, and the foreign tax return showing the income. Where the foreign documents are not in English or Arabic, keep translations. The FTA tests both that the tax was actually paid and that it is creditable tax on the income reported.
Treaty analysis belongs in the pack where a treaty affects the foreign tax rate. If the foreign country withheld more than the treaty rate allows, the excess is generally not creditable, because it was not tax properly due. Claim treaty-reduced withholding at source where the mechanism exists, rather than paying the full rate and hoping the credit absorbs it.
Branch profits and underlying tax
For foreign branch profits included in UAE taxable income, the credit covers the foreign tax on those profits. Keep the branch's foreign computations and tax proofs alongside the UAE attribution workings so the two sides reconcile.
# Planning around the limitation
Because excess credit is lost, manage the profile of foreign income across periods. Realising a large foreign gain in a year when UAE losses shelter all domestic tax wastes the foreign tax paid; spreading the realisation or timing it against taxable UAE income preserves the credit value. This is legitimate timing management, not avoidance, provided the transactions are real.
Consider the participation exemption alternative for foreign dividends: where the exemption applies, the dividend is simply exempt and no credit is needed. Model exemption versus credit for each foreign income type before filing, because the better answer varies by income type, holding and treaty position. Document the choice and apply it consistently.
# Planning around the no-carry-forward rule
Because excess foreign tax credit cannot be carried forward, the timing of foreign income against the UAE tax profile is a genuine planning variable. Realising a large foreign gain in a year when UAE losses shelter all domestic tax wastes the foreign tax paid; the same gain realised in a year with taxable UAE profits absorbs the credit fully. This is legitimate timing of real transactions, not artificial arrangement, and it should be modelled as part of the annual tax planning.
Similarly, consider the ordering of reliefs: the participation exemption may shelter foreign dividends entirely, making the credit irrelevant for that stream, while other foreign income needs the credit. Map each foreign income stream to its optimal treatment before the year end, because recharacterising after the fact is rarely possible. Document the planning as commercial decision-making with tax awareness, which is exactly what it is.
Loss years
In a UAE loss year, foreign tax credits have no UAE tax to relieve and the excess is lost. Where foreign income can be deferred to a profitable year without commercial cost, the credit value is preserved.
Keeping the proof current
Foreign tax certificates can take months to obtain. Request them during the foreign year, not at UAE filing time, so the credit claim is fully evidenced when the return is prepared.

Frequently asked questions
Can the credit reduce my UAE tax below zero?
No. The credit is limited to the UAE tax on the foreign income, so it can eliminate the UAE tax on that income but cannot create a repayment. Any foreign tax above that limit is unrelieved in the UAE for that period.
What if the foreign tax is refunded later?
If foreign tax that was credited is subsequently refunded, the UAE position must be corrected, because the credit was only available for tax actually borne. Keep the foreign position under review after filing and amend if a refund changes the creditable amount.
Does the credit apply to VAT or customs duty paid abroad?
No. The foreign tax credit relieves foreign income taxes against UAE corporate tax on the same income. VAT, customs duties and other non-income taxes are dealt with under their own rules and do not generate corporate tax credit.
