Corporate Tax
FTA Corporate Tax Assessments in the UAE: Process and Rights
The FTA can assess additional UAE corporate tax where returns are wrong or missing. Learn how assessments work and your objection rights.

Where a return understates the liability, or no return is filed, the FTA may issue a tax assessment determining the tax due, with reasons, the amount and a payment deadline. Assessments follow enquiries or audits, or arise by default where filing obligations were ignored. Penalties may be applied alongside the assessed tax. The taxpayer has the right to object within the statutory time limit, and the objection must be made properly and promptly with supporting evidence.

# When assessments are issued
The common path is assessment after review: an enquiry or audit concludes the filed position was wrong, and the FTA assesses the additional tax with its reasoning. The assessment explains the adjustments, references the evidence, and sets the payment deadline. This is the formal end of the review process and the start of the dispute or payment process.
The other path is default assessment: the taxpayer never filed, ignored information requests, or produced nothing the FTA could work with, and the Authority assesses on the best information available to it. Default assessments are rarely favourable, because they are made without the taxpayer's evidence. They are also entirely avoidable: filing the return, even late, is always better than being assessed by default.
Estimated assessments
Where records are missing, the FTA may estimate. Estimates are challenged with the actual records, which is another reason the seven-year archive matters: the business that can produce the real figures replaces the estimate with reality.
# Receiving and reviewing an assessment
On receipt, diary the objection deadline immediately; it is the most important date on the notice. Then review the assessment against your file: which adjustments were made, what evidence was relied on, and where the FTA's reasoning may be wrong. Separate the assessment into three piles: adjustments that are correct, adjustments that are wrong on the facts, and adjustments that are wrong on the law.
Engage a qualified adviser at this point if you have not already. The objection needs to be technically precise, evidentially supported and filed on time. A vague objection that the assessment is too high, without engaging with its reasoning, achieves nothing.
| Category | Action |
|---|---|
| Correct adjustments | Accept; pay promptly |
| Wrong on facts | Object with the evidence |
| Wrong on law | Object with the legal analysis |
| Unclear basis | Seek clarification urgently |
# Objecting and paying
File the objection within the time limit through the proper channel, addressing each disputed adjustment with facts and law, and attaching the supporting evidence. The objection should be complete on first filing; drip-feeding arguments weakens the case. Keep proof of timely submission.
On payment, take advice on the mechanics: whether to pay the assessed amount while objecting, pay the undisputed portion, or seek suspension of collection during the dispute. The wrong choice accrues penalties or concedes leverage. Whatever the strategy, never let the objection deadline pass while deciding; a late objection usually ends the dispute regardless of merit.
# Paying under protest
Where an assessment is disputed but the business wants to stop penalties accruing or avoid enforcement during the objection, paying under protest is the mechanism to consider with advice. The payment is made expressly reserving the right to recover it if the objection succeeds, and the reservation should be stated clearly in writing at the time of payment. Keep the payment proof, the protest letter and the objection together as one file.
The decision involves judgement: paying concedes nothing on the merits where properly reserved, but it does part with the cash during the dispute. Not paying preserves cash but lets penalties accrue and risks enforcement. There is no universally right answer; it depends on the strength of the objection, the cash position, and the attitude of the FTA to collection during disputes. Take specific advice before choosing, and do not let the objection deadline pass while deliberating.
Documenting the protest
The protest must be contemporaneous and explicit: a letter stating the payment is made under protest and without prejudice to the objection, referencing the assessment and the objection. A protest invented months later carries no weight.
Recovery on success
Where the objection succeeds, the overpaid amount is recoverable through the refund or offset process. Track the recovery actively; successful objections still need the money chased.

Frequently asked questions
Can the FTA assess a period I already filed for?
Yes, where the review concludes the filed position was incorrect. Filing does not immunise the period; it starts the review process. This is why the filing pack must support the return for the full seven-year retention period.
What happens if I do nothing about an assessment?
It becomes final and enforceable, with collection action following. Doing nothing is the worst option in every scenario. Even if you cannot pay, object in time where there are grounds, or engage on payment where there are none.
Can I negotiate the assessment informally?
Engage through the formal objection and review channels with evidence and reasoning. Informal discussions can clarify misunderstandings, but the assessment stands until formally varied. Keep everything in the proper channel so the record is clear.
Can new evidence be introduced during an objection?
Yes, and it should be: the objection is the occasion to put the complete evidential case. Attach the records supporting each disputed adjustment with clear references. An objection that promises evidence later is weaker than one that delivers it with the filing.
