Do real estate agents pay UAE corporate tax? Commission income, brokerage structures, the threshold, deductions, and filing explained.
real estate agent corporate tax uae
Real estate agents pay UAE corporate tax on brokerage and commission income when turnover exceeds AED 1 million in a calendar year. Independent agents are taxed as natural persons at 0% on taxable income to AED 375,000 and 9% above, with Small Business Relief available until end-2029. Employed agents' salaries are excluded. Deductible costs include marketing, portal listings, transport, and licence fees. Commission splits with brokerages need clear documentation.

# Commission income and the threshold
An agent's turnover is gross commission earned — the full commission on each deal before the brokerage takes its split. An agent closing AED 30 million of sales at 2% commission earns AED 600,000; at a 50% brokerage split the agent keeps AED 300,000 — but turnover is the AED 600,000 gross commission, not the AED 300,000 net.
This gross-commission rule surprises agents: the money never touched your account in full, but the threshold counts what you earned before the split. Keep the brokerage's commission statements showing gross commission per deal and the split applied.
Top agents cross fast: AED 1 million of gross commission is roughly AED 50 million of transacted value at 2%. In Dubai's market, productive agents reach that in a strong year. Track cumulative gross commission monthly, not just your take-home.
# Employed vs independent agents
Employed agents on salary plus commission as employees: the whole package is employment income — excluded. Independent agents contracted to brokerages, paid commission splits, bearing their own costs: business income — tested.
The brokerage agreement reveals the substance: who bears the marketing costs, who sets the working pattern, whether the agent can work for other brokerages. Exclusivity plus control leans employment; independence plus own costs leans business.
Misclassification is common in the industry — 'self-employed' agents working exactly like employees. Get the classification right for labour, visa, and tax together; a single coherent position across all three is the only safe one.
| Indicator | Employment | Independent business |
|---|---|---|
| Pay structure | Salary + employee commission | Commission split, own costs |
| Marketing costs | Borne by brokerage | Borne by agent |
| Exclusivity | Exclusive, controlled hours | Free to multi-list |
| Tools | Provided | Own CRM, own car |
| Tax | Excluded salary | Threshold-tested turnover |
# Deductible costs for agents
Marketing is the agent's biggest deduction: portal listings (Property Finder, Bayut), personal branding, photography, social media advertising. Keep platform invoices — 'AED 40,000 marketing' with no invoices is not a deduction.
Transport between viewings (business share with mileage log), phone (business share), professional photography and staging for listings, and RERA/broker licence and training fees follow. Client entertainment faces the specific restrictions — verify current guidance.
Brokerage desk fees and franchise fees are deductible business costs with the brokerage's invoices. Referral fees paid to other agents need agreements and payment proof — undocumented referral cash is routinely disallowed.
# Off-plan, leasing, and property management income
Off-plan commissions follow the same gross-commission rule — large ticket sizes mean large commissions, and a few off-plan deals can cross the threshold alone. Recognise commission when earned under your consistent method, typically on deal completion.
Leasing commissions aggregate with sales commissions for the threshold test — one business, one total. Property management fees for managing landlords' units are also business turnover; if management becomes systematic and sizable, it is part of the same tested activity.
Do not confuse commission income with property income: an agent who also owns rental property keeps the two activities' records separate. Commission is always business turnover; the rental property is assessed on its own investment-or-business character.
# Team leaders and growing agencies
Successful agents build teams — junior agents under their split, admin support, marketing staff. Team overrides and referral income are the leader's business turnover; junior agents' pay is the leader's deductible cost (with contracts).
At team scale the natural-person wrapper strains: payroll admin, liability, brand. Many team leaders incorporate the agency — moving to company taxation from day one. Time it at year-end, value the pipeline and brand properly on transfer, and novate the brokerage relationships.
Plan the 2030 transition during the relief window: a team leader with AED 2.5 million of gross commission elects Small Business Relief through 2029, then faces real tax from 2030. Provision from 2029 profits — the bill arrives whether or not the market stays hot.

Frequently asked questions
Is my turnover the full commission or my split?
The full gross commission before the brokerage's split. If a deal generated AED 60,000 commission and the brokerage kept 50%, your turnover is AED 60,000, not AED 30,000. The brokerage's share is effectively your cost of the brokerage relationship — turnover stays gross.
I am on a 50/50 split with my brokerage. Am I employed?
Not necessarily — the split alone does not decide status. Assess control, exclusivity, who bears costs, and working patterns. Many genuine independent agents work on splits; many 'self-employed' agents are employees in substance. Apply the full indicator set, not just the pay structure.
Are portal listing fees deductible?
Yes — Property Finder, Bayut, and similar listing costs are deductible marketing expenditure with the platform's invoices. They are among the cleanest agent deductions: wholly for the business, easily evidenced, directly tied to earning commission.
Do off-plan commissions count differently?
No — commission is commission. Large off-plan deals simply move the threshold number faster. Recognise the commission when earned under your consistent method and track cumulative gross commission through the year; a single quarter of strong off-plan closings can trigger registration.
Should I set up my own brokerage?
When the team, brand, and deal flow justify it — a commercial decision with tax modelled. Incorporation ends the natural-person threshold benefit and starts company taxation and compliance from day one. Many agents incorporate in the AED 1.5–3 million commission band; the trigger is usually liability and growth, not tax.
