# What a tax assessment is
A tax assessment is the Authority's own determination of the tax position, issued as a formal decision. It typically follows an audit, but it can also follow a failure to file, where the Authority assesses on the best information available, or a review that concludes the return was wrong. The assessment states the taxable income as determined, the tax payable, the penalties imposed and the reasoning.
The assessment is a decision of the Authority, which means it enters the dispute ladder like any other decision. It is not a preliminary view or a negotiating position; it is the Authority's concluded position unless and until changed through review, reconsideration, the Committee or the court.
Read the assessment carefully on receipt. Identify the tax periods covered, the adjustments made and the penalty items applied. The 40-business-day review clock and the 20-business-day payment clock both run from receipt, so the first administrative act is to record the receipt date precisely.
Estimated assessments
Where no return was filed, the Authority may assess on the best available information, including estimates. An estimated assessment is challengeable like any other, but the evidential burden shifts uncomfortably: the Authority estimated because you gave it nothing to work with, so come to the review with the actual figures.
Assessments after audit
The commonest assessment follows an audit and reflects the final audit findings. The draft-report stage was the moment to contest the facts; the assessment stage is the moment to contest the decision through the formal ladder.
# Paying the assessed tax
Tax payable under an assessment is due within 20 business days of receipt, per item 8(2) of the penalty table. After that window, the 14 percent per annum late payment penalty starts on any unsettled amount. The payment obligation stands even while you dispute the assessment; challenging does not suspend payment on its own.
Pay through EmaraTax specifying corporate tax and the tax period, and reconcile against the ledger. Where the assessed amount is genuinely unpayable in full, apply for an instalment arrangement under Article 50 rather than defaulting; enforcement powers, including asset attachment, become available once the payment window closes without payment.
The payment precondition for later stages makes early payment doubly important. The Committee will not accept an objection until the disputed tax is paid in full, and the court requires tax plus half the penalties. Paying the assessment preserves every later option; not paying closes them.
Paying under protest
Pay the assessed amount while clearly recording that it is disputed and that review has been or will be requested. Payment is not acceptance; the dispute ladder remains fully available.
# Challenging the assessment
The first challenge route is the assessment review under Article 28: within 40 business days of notification, ask the Authority to review the assessment. Frame the request around the assessment's own reasoning, addressing each adjustment with evidence. The Authority decides within 40 business days and notifies within 5.
If the review does not resolve the dispute, the resulting decision goes to reconsideration under Article 29, and the ladder continues to the Committee and the courts. Each stage has its own 40-business-day deadline running from the previous decision's notification.
Triage the assessment before choosing how hard to fight. Separate the adjustments into three piles: wrong on the facts, arguable on the law, and correct. Concede the correct ones promptly, which builds credibility, fight the wrong ones with evidence, and take advice on the arguable ones. A blanket challenge to every line reads as denial; a targeted challenge reads as a case.
