# The category in 60 seconds
Excise tax runs on monthly tax periods, and the return and payment are both due within 15 days of the month's end.
The governing law is Federal Decree-Law No. 7 of 2017 on Excise Tax, as amended, with the categories, rates and calculation methods set by Cabinet Decision No. 197 of 2025 (issued 27 November 2025, in force 1 January 2026). The Executive Regulation (Cabinet Decision No. 37 of 2017 (Executive Regulation of the Excise Tax Law), as amended) handles procedures; Cabinet Decision No. 40 of 2017 as amended (Administrative Penalties) sets the administrative penalties; and the Tax Procedures Law (Federal Decree-Law No. 28 of 2022 on Tax Procedures) governs records, assessments and disputes.
Four categories pay 100% of the excise price — tobacco, e-liquids, vaping devices and energy drinks. Sweetened drinks pay per-litre amounts set by sugar bands. The old 50% carbonated-drinks category is gone: fizz alone no longer triggers excise.

# Who must register — and when
Registration is triggered by activity, not turnover: importing excise goods, producing them, or stockpiling them with tax unpaid. There is no threshold — the first unit can trigger the duty. Applications run on EmaraTax, the FTA issues a 15-digit TRN, and obligations run from the effective date.
Register before the first activity. Late registration costs AED 10,000 under Cabinet Decision No. 40 of 2017 as amended, and goods can be held at customs while the position is regularised. Pure downstream resellers of tax-paid goods generally do not register — their duty is provenance: registered suppliers and complete invoices.
# How the tax is calculated
100% goods (tobacco, e-liquids, devices, energy drinks): the tax equals the excise price — in practice, half the designated retail sale price. The excise price is the higher of the FTA's standard price list and the RSP minus included tax (Articles 11–12). Strip VAT before halving; VAT is then charged on the excise-inclusive price.
Sweetened drinks: per-litre bands — AED 1.09 at 8g+ sugar/100ml, AED 0.79 at 5g to under 8g, AED 0 below 5g or for artificial-only. Natural sugars count; concentrates are banded on the finished drink; an accepted lab report is effectively mandatory (no report = top band).
Round per good to four decimals at registration and to the fils on the return (Article 10(4)).
# Filing, payment and the monthly rhythm
Twelve monthly tax periods a year; each return and its payment due within 15 days of month-end. Nil returns in quiet months. Payment via EmaraTax-linked channels with exact references; the FTA applies payments to oldest debt first.
Late filing: AED 1,000 first, AED 2,000 on repetition. Late payment: 14% per annum, charged monthly on the unpaid tax. Amend errors via amended returns or voluntary disclosure — voluntarily and fast beats discovered every time.

Capture the month's movements
Imports, production, releases, sales, samples, wastage — every unit.
-
Calculate per SKU
Halving rule or band multiplication, with RSP/lab evidence behind each figure.
-
Reconcile stock
Opening + in − out = closing; investigate variances before filing.
-
File and pay within 15 days
EmaraTax return, correct payment reference, archived receipt.
# Refunds, penalties and records
Refunds arise mainly on exports/re-exports and genuine overpayments — claimed on EmaraTax with a full evidence chain, or offset against future liability. Every claim is scrutinised; broken chains are refused.
Penalties run from AED 1,000 paperwork fines to multiples of tax for evasion, plus criminal referral at the top end. Relief routes: voluntary disclosure, reconsideration, and the Tax Disputes Resolution Committee.
Records must reconstruct the position for five years: movements, invoices, RSP evidence, lab reports, payment receipts. Digital is fine if complete and retrievable.
# Category deep dive: the legal detail that decides cases
The 2026 framework consolidated years of piecemeal decisions into a single Cabinet Decision. Read it as a whole: the definitions in Article 1, the five categories in Articles 3–7, the rates in Article 10, the excise-price mechanics in Articles 11–12, and the FTA's evidence powers in Article 13. Businesses that master those thirteen articles master UAE excise.
Beyond the category articles, three provisions decide the hard cases. Article 8 excludes alcohol-containing drinks from the energy and sweetened categories — a spiked drink is not an energy drink for excise, whatever its caffeine content. Article 9 prevents double taxation where a taxed concentrate is mixed at the point of sale for a non-taxable person: the finished serving is not a new excise good, and the tax already paid cannot be deducted elsewhere. Article 13 gives the FTA its teeth: it can demand documents, lab tests and ingredient evidence to prove classification, treat unproven products as excise goods in the meantime, and default sweetened drinks without accepted lab reports to the highest sugar band. In practice, Article 13 means the burden of proof sits with the business — the FTA does not have to prove your product is taxable; you have to prove it is not, with the lab report or the customs code in hand.

Frequently asked questions
What are the UAE excise tax rates in 2026?
Tobacco, e-liquids, vaping devices and energy drinks: 100% of the excise price. Sweetened drinks: AED 1.09 per litre at 8g+ sugar/100ml, AED 0.79 at 5g to under 8g, AED 0 below 5g or for artificial-only drinks. All under Cabinet Decision No. 197 of 2025, in force 1 January 2026.
Who has to register for excise tax?
Anyone who imports, produces or stockpiles excise goods in the UAE — with no turnover threshold. Registration is on EmaraTax before the first activity, and late registration costs AED 10,000. Pure resellers of tax-paid goods generally do not register. Check your activities against the five categories before assuming either way.
When are excise tax returns due?
Monthly: each calendar month is a tax period, and the return plus payment are due within 15 days of month-end. Nil returns are required in quiet months. Late filing attracts AED 1,000 (AED 2,000 on repetition) and late payment accrues 14% per annum.
How is the 100% excise tax actually calculated?
For 100% goods the tax equals the excise price — in practice half the designated retail sale price, which is the VAT-exclusive retail price or the market average, whichever is higher, subject to the FTA's standard price list. VAT is then charged on the excise-inclusive amount.
Can excise tax be refunded?
In limited cases: mainly exports and re-exports of tax-paid goods, and genuine overpayments (excess refundable tax). Claims go through EmaraTax with full evidence chains, or the excess can be offset against future liability. Every claim faces close FTA scrutiny. Confirm current processing timelines on tax.gov.ae before planning cash flow around a claim.
What records must excise businesses keep?
Five years of everything that reconstructs the position: import declarations, production logs, stock movements, invoices, RSP evidence, lab reports for sweetened drinks and payment receipts. Digital records are acceptable if complete, unalterable and retrievable. Organise them by tax period for fast retrieval.
Where can I read the actual law?
Start with the unofficial translation of Cabinet Decision No. 197 of 2025 on tax.gov.ae, then the FTA's excise guides and public clarifications on the same site. The Arabic text prevails in disputes, so treat translations as working documents. For borderline classifications and RSP disputes, a written FTA clarification or a specialist opinion beats any secondary source — including this site.
