Excise Tax on Staff Sales and Discounts
Staff discounts do not reduce the excise base: tax is calculated on the excise price (RSP-based), not the discounted till price.
excise tax on staff sales and discounts
Discounts move the till price, not the tax: excise is anchored to the excise price, not what staff paid. Excise tax periods are calendar months, and for each month the registered person files a return and pays the tax due within 15 days of month-end — through EmaraTax, by card via MagnatiPay or by bank transfer to your GIBAN. Quiet months still need nil returns.

# The monthly cycle, end to end
Discounts move the till price, not the tax: excise is anchored to the excise price, not what staff paid.
There is no quarterly option and no annual return: twelve periods, twelve returns, twelve payments. The cycle for each month is: capture every excise movement (imports, production, releases, sales, stock changes), calculate the tax per SKU — 100% of excise price or the per-litre band — reconcile stock to the return, file on EmaraTax, and pay. Then archive the month's evidence file for five years.
# Filing on EmaraTax: what goes where
The return reconciles the month's excise position: goods imported, goods produced, goods released for consumption, and the tax calculated on each line. Sweetened drinks are reported by sugar band with lab-report references; 100% goods by excise price with RSP references.
Before submitting, run the pre-filing checks: RSPs current, bands evidenced, stock reconciled, imports matched to customs declarations, and the payment reference ready. An amended return or voluntary disclosure fixes errors — voluntarily and fast is always cheaper than discovered.
-
Close the month's excise movements
Imports, production, releases, sales, samples, wastage — every unit accounted for.
-
Calculate per SKU
100% of excise price, or per-litre band; round per good to four decimals at registration stage, to the fils on the return.
-
Reconcile stock
Opening + in - out = closing. Investigate every variance before filing.
-
File on EmaraTax within 15 days
Submit the return; nil returns in quiet months.
-
Pay and keep proof
Pay via accepted channels with the correct reference; archive the receipt for five years.
# Payment: methods, matching and proof
Pay through EmaraTax — by card via the MagnatiPay gateway or by bank transfer to your GIBAN (the FTA has not accepted eDirham since 30 October 2022). The reference number is critical: a payment the FTA cannot match to your account is a payment you have not made, legally speaking. Keep bank confirmations and EmaraTax receipts for five years.
Where several periods are owed, the FTA applies payments to the oldest debt first — so a payment you meant for this month may legally clear last month's arrears, leaving this month still 'unpaid' for penalty purposes. Clear arrears deliberately, oldest first.
# Reconciling excise with your financial accounts
The excise return and the financial statements must tell the same story. Monthly, reconcile: the return's import lines to customs declarations and purchase ledgers; production lines to batch logs and inventory; sales lines to the revenue ledger; and the closing stock to the balance sheet inventory.
Excise paid is part of inventory cost — it sits in cost of goods sold as the goods sell, not as a recoverable tax asset. VAT accounting runs alongside: the VAT return's excise-inclusive values should foot to the excise return's tax base where they overlap. Differences the business cannot explain are exactly what FTA data-matching is built to find.
Close the month with a signed reconciliation pack — return, stock count, movement log, calculation trail — and archive it for five years.
# When things go wrong: corrections and disclosures
Found an error after filing? Small slips can go through an amended return; material errors belong in a voluntary disclosure, ideally within 20 days of discovering them. Voluntary correction dramatically improves the penalty outcome versus FTA discovery.
If you cannot pay on time, pay what you can — partial payment at least stops interest accruing on the portion paid. Document any EmaraTax technical failure with screenshots and timestamps, but do not treat a glitch as an extension: file by every available means.

Frequently asked questions
What is the excise tax return deadline in the UAE?
The return and the payment are both due within 15 days of the end of each monthly tax period. For January, that means mid-February. There is no routine extension, and weekends or holidays do not safely extend the deadline — file and pay early.
Do I need to file if I had no excise activity this month?
Yes — file a nil return. Registered persons must file for every tax period, including quiet months. Skipping a nil return is treated as late filing and attracts the AED 1,000 penalty (AED 2,000 on repetition). A nil return takes minutes; the penalty does not.
How do I pay excise tax in the UAE?
Through EmaraTax: by Visa or Mastercard card via the MagnatiPay gateway, or by bank transfer to your GIBAN. The FTA stopped accepting eDirham on 30 October 2022. Use the exact payment reference so the FTA can match your payment to your account, and keep the receipt for five years. A mismatched reference can leave the debt technically unpaid.
Can I correct an excise return after filing?
Yes. Minor errors can be fixed with an amended return; larger errors should go through voluntary disclosure, ideally within 20 days of discovery. Correcting voluntarily and quickly produces a far better penalty outcome than waiting for the FTA to find the error in an audit.
What if EmaraTax is down on deadline day?
Document the failure with screenshots and timestamps, try every available channel including the FTA contact centre, and file the moment the portal recovers. A technical failure is mitigation, not an extension — the deadline still stands. Keeping a paper trail of the attempted filing supports any later reconsideration request against late-filing penalties.
