Why Hotel and Restaurant Prices Do Not Set the RSP
Inflated hotel and restaurant prices are excluded from the RSP definition. Why the law carves them out — and what counts instead.
why hotel and restaurant prices do not set the rsp
The minibar price is not the RSP: on-premise markups are excluded by law. Under Articles 11 and 12 of Cabinet Decision No. 197 of 2025, the excise price for 100% goods is the higher of the FTA's published standard price (if any) and the designated retail sale price minus included tax — which Article 11(2) simplifies to half the designated retail sale price.

# The RSP in the excise formula
The minibar price is not the RSP: on-premise markups are excluded by law.
The chain is short and unforgiving: the RSP feeds the excise price, the excise price feeds the tax, and the tax feeds the VAT base. A 10% error in the RSP is a 10% error in the excise — and then VAT compounds it. This is why RSP discipline is the highest-leverage compliance activity for any 100% goods business.
Note the two 'higher of' tests stacked in the law: your declared price versus the market average (Article 12), and then that result versus the FTA's standard price list (Article 11). The law systematically picks the highest defensible number — under-declaring the RSP does not survive contact with either test.
# Declaring and evidencing your RSP
Declare the RSP to the FTA before the goods move, with the evidence behind it: recommended price lists, distributor price notifications, shelf-price surveys and the VAT-exclusive arithmetic. Keep a dated change log — every price change needs its reason and evidence, because the FTA tests chronology as well as level.
For new products with no market history, set a reasoned launch RSP and document the reasoning: comparable products, cost-plus analysis, intended positioning. 'We guessed' is not a defence; 'here is our documented methodology' is.
| Step | Compare | Result |
|---|---|---|
| Declared VAT-exclusive retail price vs average market retail price | Higher = designated RSP |
| FTA standard price list vs designated RSP (less included tax) | Higher = excise price |
| 100% of excise price | Tax = half the designated retail sale price |
# Promotions, pack sizes and market reality
Temporary promotions do not rewrite the RSP — discount the shelf price freely, the declared RSP stands. But a permanent price repositioning should be declared as a new RSP with its evidence. Different pack sizes are different SKUs with their own RSPs; do not average them.
If your genuine retail price sits below the market average, the average becomes your base — the law's anti-avoidance tilt. Discounters should model this before setting prices: the excise saving from a low price may be smaller than expected, because the base follows the market, not your ticket.
# The standard price list in practice
The FTA's published standard price list is the quiet giant of excise valuation: where it lists your good, its price caps your planning — the excise price is the higher of the list and your RSP calculation. Check the list before setting launch prices, before declaring RSPs, and before assuming a discount strategy reduces the tax base.
Where your good is not listed, the Authority can add it — Article 13(2) gives the FTA the procedure for adding products to the list. A product that trades at scale without a list price should expect one eventually. Price strategy for 100% goods should therefore be built on defensible, evidenced RSPs from day one, not on the absence of a list entry.
# When the FTA substitutes its own price
If the FTA rejects your RSP or applies its standard price list, you will be assessed on the higher figure — with penalties where the original declaration is treated as incorrect. Challenge with market evidence: dated shelf-price surveys, distributor communications, and comparable-product analysis.
Reconsideration is the first route; the Tax Disputes Resolution Committee the second. The strongest position is always the preventive one: a declared, evidenced, logged RSP that the FTA has no reason to disturb.

Frequently asked questions
What is the designated retail sale price for excise tax?
The higher of your declared recommended retail selling price (after deducting VAT) and the average retail market price after VAT, per Article 12 of Cabinet Decision No. 197 of 2025. Hotel and restaurant markups are excluded. The FTA's published standard price list overrides both if higher — the excise price is the highest of the available measures.
How does the RSP translate into the actual tax?
For 100% goods, Article 11(2) makes the tax equal to half the designated retail sale price. A product with an RSP of AED 100 carries AED 50 of excise. VAT is then charged on the excise-inclusive price. Get the RSP right and the rest is arithmetic.
Do discounts and promotions change the RSP?
Temporary promotions do not change the declared RSP — the tax stays anchored to it. A permanent price change should be declared as a new RSP with supporting evidence. Keep a dated change log distinguishing promotions from repositioning, and document the evidence behind each decision.
Can the FTA change my RSP?
Yes — through the standard price list (which prevails if higher) or by rejecting an unsupported declaration and substituting its own figure, typically the market average. You can challenge via reconsideration and the TDRC with market evidence, but prevention through proper declaration is far cheaper.
How often should the RSP be reviewed?
At least quarterly, and immediately after any permanent price change, competitor repricing that moves the market average, or an FTA standard-price-list update. Temporary promotions do not trigger a review, but a promotion that becomes permanent is a new RSP. Keep the review diary with the change log.
