End-of-Service in Dubai: Taxed in Ireland?

Dubai gratuity taxed in Ireland? UAE pays it tax-free; the Irish treatment, termination exemptions and payment timing explained. Tax-only guide.

dubai gratuity taxed in ireland

Irish expat end-of-service tax: the UAE pays your gratuity under Federal Decree-Law No. 33 of 2021 with zero UAE tax. Ireland decides the real outcome: a gratuity received while Irish tax resident is generally taxable employment income subject to Ireland's termination-payment exemptions, while one received while genuinely non-resident may escape the Irish net. This guide covers the calculation, the Irish treatment, payment timing, and the costliest traps.

# How UAE end-of-service gratuity works

The UAE end-of-service gratuity is a statutory entitlement, not a favour: under Federal Decree-Law No. 33 of 2021, an employee with at least one year of continuous service is entitled to 21 days' basic wage for each of the first five years and 30 days' basic wage for each additional year, capped at two years' total wages. Basic wage means basic salary excluding allowances — a distinction that matters, because gratuity on an all-inclusive salary figure is a common payroll error in the employee's favour or against it. Resignation versus employer termination affects the calculation for shorter service. The payment is made in full with zero UAE tax: no withholding, no filing, no deductions. Get the calculation in writing from your employer and check the inputs — service start date, basic wage figure, and whether any unpaid leave or absences were deducted. For most departing expats the gratuity is the largest single receipt of the exit year, which is exactly why the Irish treatment below deserves more attention than the UAE calculation. Our UAE gratuity guide covers the calculation mechanics, disputes and the documentation to keep.

Basic wage, not total package

Basic wage excludes housing, transport, schooling and other allowances — gratuity is computed on the basic salary line of your contract. If your contract states an all-inclusive salary with no basic-wage split, the gratuity base needs establishing before the calculation, not during a dispute after it. Check the contract now.

# Will Ireland tax your gratuity?

Ireland taxes its residents on worldwide employment income, and a gratuity received while Irish tax resident is generally taxable as income from the employment — subject to Ireland's termination-payment exemption structure. The structure provides a basic exemption and an increased exemption with defined statutory amounts, and the conditions matter: the exemptions interact with pension lump sums taken around the same time, and only the excess over the available exemption is taxable (as of 2026: a basic exemption of €10,160 plus €765 per complete year of service, an increased exemption of up to €10,000 more, or SCSB, all within a €200,000 lifetime limit). General information on Irish law only — the exempt slice needs computing on your facts, not assumed. Received while genuinely non-resident in Ireland, the gratuity is generally outside the Irish net: Ireland taxes non-residents on Irish-source income, and a Dubai gratuity for Dubai work is not Irish-source. But two overlays can change that clean answer. First, ordinary residence: if you remained ordinarily resident through the Dubai years, certain Irish connections stay taxable. Second, straddling service: if part of the accrual period was worked while Irish-resident (an intra-group Dublin-to-Dubai transfer, for instance), Ireland can tax the apportioned slice. General information only. The treaty (in force since 21 July 2011) supports this analysis through its employment article, which allocates taxing rights over employment income broadly to the country where the work was performed.

The exemption slice needs computing

Ireland's termination-payment exemptions are statutory amounts with conditions — they are not a blanket exemption and they are not automatic. The available exemption depends on your circumstances, including pension lump sums and the nature of the payment. Have the exempt slice computed under Irish rules before you decide what is taxable. General information on Irish law only.

Straddling service: apportion the accrual

If your Dubai employment began with an Irish contract or an intra-group transfer, part of the gratuity's accrual period may be Irish-resident service. Ireland can tax that apportioned slice even if the payment arrives during the Dubai years. Map the service history against residence periods and get the apportionment advised — do not assume continuous service means continuous non-residence. General information only.

# Timing the payment across the return date

The payment date, not the entitlement date, is the variable that decides the Irish outcome — and it is negotiable. A gratuity paid while you are still Dubai-resident and genuinely non-resident in Ireland is generally outside the Irish net; the identical payment landing a month later, after your Irish residence has restarted, is taxable employment income subject to the exemptions. General information on Irish law only. This makes the settlement timeline a tax decision disguised as HR admin. Agree the payment date explicitly with your employer, get it in writing, and model it against your return date before the flight is booked. Do not accept an accelerated payment without checking where it lands: an early payment that arrives after the return date can cost more in Irish tax than the acceleration was worth. Equally, do not delay a payment into a new Irish tax year without advice — the year of receipt is its own variable. Accrued leave encashment and trailing bonuses follow the same logic: each receipt mapped against the residence cut-off, each timed deliberately.

Final payroll is not the payment date until it is paid

Employers often pay the gratuity with the final payroll run, which may be weeks after the last working day — and potentially after your return flight. The last working day is not the payment date. Confirm the actual payment date in writing and, if it falls on the wrong side of your residence cut-off, negotiate it before the payroll is processed. General information on Irish law only.

# Termination packages beyond the gratuity

Few exits are a clean gratuity-only payment. Final settlements routinely bundle contractual notice pay, payment in lieu of notice, ex-gratia amounts, non-compete or non-solicitation payments, accrued leave, and trailing bonuses or commissions — and Ireland does not treat them all as gratuity. Notice pay and PILON are generally taxable employment income; ex-gratia elements are fact-sensitive; non-compete payments have their own characterisation questions; accrued leave is employment income of the termination. General information on Irish law only. The practical step is decomposition: break the final settlement into its contractual components, have each one classified under Irish rules, and only then compute the termination-payment exemptions against the qualifying slice. A single lump sum described as gratuity on the payslip may contain several differently-taxed elements — the label on the employer's paperwork does not decide the Irish treatment. Keep the settlement agreement, the employment contract and every payslip: the classification evidence is the paperwork, not the memory.

Non-compete and ex-gratia need separate classification

Non-compete and ex-gratia payments are the most commonly misclassified elements: paid as part of the exit, assumed to be gratuity, taxed differently in Ireland. If your settlement includes either, have it classified separately under Irish rules before the money moves. General information only.

# Pension and social-insurance angles

Two related items belong on the gratuity checklist. First, pensions: the gratuity is not a pension, and Ireland's pension lump-sum rules are a separate regime — but the termination-payment exemptions interact with pension lump sums taken around the same time, so coordinate the two rather than planning each in isolation (as of 2026: a basic exemption of €10,160 plus €765 per complete year of service, an increased exemption of up to €10,000 more, or SCSB, all within a €200,000 lifetime limit). General information only. Second, voluntary employer savings or provident schemes: some Dubai employers run them alongside the statutory gratuity, and on exit they pay out as lump sums whose Irish character (employment income, pension benefit, or return of own contributions) needs classifying before payout. Finally, the social-insurance footnote: gratuity years in Dubai are years outside the Irish PRSI system, which can affect future State pension entitlements — a benefits question for the Department of Social Protection, worth asking while the exit paperwork is open.

Coordinate with any Irish pension lump sum

Taking an Irish pension lump sum in the same year as the Dubai gratuity can change the available termination-payment exemptions — the two regimes interact. If both are on the table, sequence them with Irish advice rather than letting the dates fall where they may. General information on Irish law only.

# The five costliest gratuity mistakes

Gratuity files go wrong in a handful of predictable ways. The amounts are large, the timing is tight, and the Irish analysis is date-driven — which is why almost every mistake below is a date mistake.

# Tax-equalised packages and hypothetical tax

Many Irish expats in Dubai — especially intra-group transferees — work under tax-equalisation policies: the employer deducts a hypothetical Irish tax from salary and settles the actual tax position itself. On exit, equalisation complicates the gratuity analysis in two ways. First, the gratuity may be equalised too, meaning the employer — not you — bears the Irish tax on it; the settlement statement should show the gross-up explicitly. Second, equalisation settlements routinely straddle the return date: the final equalisation computation for the Dubai years may land after you are Irish-resident again, and its treatment needs classifying separately from the gratuity itself. General information only. Get the equalisation policy document and have each exit payment mapped to it: which amounts the employer grosses up, which it does not, and who bears the Irish tax on each. An equalised gratuity paid grossed-up is a different Irish filing from a non-equalised one — and the employer's payroll team will not make that distinction for you. Keep the policy, the hypothetical-tax calculations and the settlement statements with the exit file indefinitely.

Who bears the Irish tax on the gratuity?

Under equalisation, the answer should be in the policy: some employers equalise termination payments, others exclude them. If the gratuity is equalised, the Irish tax cost sits with the employer and your filing shows the grossed-up amount; if it is excluded, the cost sits with you. Do not assume — read the policy clause on termination payments specifically. General information only.

Final equalisation settlements after the return

The last equalisation true-up for the Dubai years often arrives months after the return to Ireland. It is a separate receipt from the gratuity with its own Irish character — potentially employment income of the year of receipt. Have it classified on arrival rather than treating it as a footnote to the exit. General information on Irish law only.

# Book a gratuity tax review

The gratuity is the largest receipt of most Dubai exits and the most date-sensitive: the same payment can be outside the Irish net or fully taxable depending on when it lands against your residence position. A gratuity tax review classifies your final settlement — gratuity, notice, ex-gratia, leave, trailing pay — against a properly caveated Irish picture prepared with Irish counsel, times the payment against the return date, and computes the termination-payment exemptions on your facts. It is fixed-scope and plain-language, built for people mid-exit — not for tax departments. Book it before the settlement date is agreed, because after the money moves the only remaining work is filing it correctly.

FAQ Answers to the questions people actually ask

Frequently asked questions

How is my UAE gratuity calculated?

21 days' basic wage for each of the first five years of service, plus 30 days' basic wage for each additional year, capped at two years' total wages — provided you complete at least one year of continuous service. Resignation versus termination affects the calculation for service under five years. Get the written calculation from your employer and check it: payroll errors on gratuity are common. This is UAE statutory entitlement, not tax advice.

Is my gratuity taxed in the UAE?

No. The UAE levies no tax on the gratuity, final salary, accrued leave or any other termination payment — the full amount arrives whole. There is no withholding and nothing to file with the FTA. The tax question sits entirely in Ireland and turns on your residence when the payment is received.

Will Ireland tax my gratuity if I receive it after returning?

Generally yes, as employment income — subject to Ireland's termination-payment exemption structure, which provides statutory basic and increased exemptions with defined amounts (as of 2026: a basic exemption of €10,160 plus €765 per complete year of service, an increased exemption of up to €10,000 more, or SCSB, all within a €200,000 lifetime limit). The exemptions have conditions (including around pension lump sums taken at the same time), so the taxable slice needs computing, not assuming. General information on Irish law only.

What if the gratuity is paid while I am still Dubai-resident?

It may escape the Irish net entirely — a gratuity received while genuinely non-resident in Ireland is generally outside Irish income tax, because Ireland taxes non-residents only on Irish-source income. But ordinary residence can keep certain connections taxable, and the domicile overlay matters. Get Irish advice on the receipt-date position; the payment date is the critical variable. General information only.

Can the payment date really change the Irish tax?

Yes — and this is where files go wrong. Ireland looks at receipt and residence: a gratuity paid after your Irish residence restarts is taxable even though every dirham was earned in Dubai. Agree the settlement date with your employer in writing and model it against the return date. An accelerated payment that lands after the return can cost more in Irish tax than the delay was worth. General information on Irish law only.

My package includes more than the gratuity — how is it taxed?

Break it into components: statutory gratuity, contractual notice pay, ex-gratia amounts, non-compete payments and accrued leave can each have different Irish treatment. Ex-gratia and non-compete elements are particularly fact-sensitive. Have each component classified under Irish rules before the money moves — a single lump sum described as gratuity may not all be gratuity for Irish purposes. General information only.

I transferred from Dublin to Dubai with the same employer — any Irish tax?

Potentially, if part of the accrual period overlaps Irish residence — for example, an intra-group transfer from Dublin to Dubai with continuous service. The gratuity accrues over the whole employment, and Ireland can tax the portion attributable to Irish-resident work periods. Get Irish advice on apportionment rather than assuming the Dubai years shield everything. General information on Irish law only.

Do I declare the gratuity on my Irish return?

Yes. A gratuity received while Irish-resident is employment income of that year — declare it, apply the termination-payment exemptions, and pay what is due. The Common Reporting Standard means Revenue can see the UAE account it was paid into; an undeclared gratuity is one of the easiest enquiries Revenue ever opens. General information on Irish law only.

When should I get advice on the gratuity?

Before the settlement date is agreed with your employer — in practice, as soon as departure is on the table. The valuable planning (payment timing against the return date, component classification, apportionment for straddling service) all happens before the money moves. After payment, only documentation remains. A fixed-scope review with Irish counsel input covers it in one pass.

My employer tax-equalises me — does the gratuity analysis change?

The mechanics change, not the principles. If the gratuity is covered by the equalisation policy, the employer bears the Irish tax via a gross-up and your filing reflects the grossed-up amount; if termination payments are excluded from the policy, you bear it. Read the policy's termination clause specifically and have each exit payment mapped to it. The final equalisation true-up itself needs separate Irish classification. General information only.

What is hypothetical tax and why does it appear on my payslip?

Hypothetical tax is the notional Irish tax your employer deducts under a tax-equalisation policy — an internal payroll mechanism, not a payment to Revenue. It keeps your net pay equivalent to an Irish-based peer while the employer settles the real tax. On exit, reconcile the hypothetical deductions against the actual position: over- or under-deductions surface in the final settlement. Keep the calculations; they are part of the exit file. General information only.
