# How UAE gratuity actually works

Sri Lankan expat tax in the UAE on end-of-service benefits starts with the calculation, because you cannot plan the tax on a number you have not computed. Under Federal Decree-Law No. 33 of 2021 (Article 51), an employee with at least one year of continuous service is entitled to end-of-service gratuity: 21 days of basic wage for each year of the first five years, and 30 days of basic wage for each additional year. The total is capped at two years' wages, part-years are calculated pro rata, and days of absence without pay are excluded. "Basic wage" means exactly that - allowances are not included unless your contract says otherwise, a frequent source of disappointment. The gratuity is payable within the statutory settlement period after the contract ends, and in the UAE the employee receives it free of personal income tax. Get the written computation from HR and check it yourself: payroll errors in gratuity maths are common, and they are much easier to fix before the final settlement is signed.

The one-year eligibility threshold

No full year of continuous service means no statutory gratuity: the one-year mark is a cliff, not a slope. Resign at eleven months and the statutory entitlement is zero, although contracts sometimes improve on the statute. If you are approaching the threshold, a few weeks can be worth a full year's accrual. Check your joining date against the employment contract rather than memory, and get any contractual enhancement confirmed in writing before you act on it.

Basic wage disputes

The most common gratuity dispute is the definition of basic wage: employers compute on the contract's basic salary while employees argue long-standing allowances were really fixed pay. Decision-makers look at the contract and the actual payment pattern. If your payslip has shown the same allowance monthly for years, an argument exists, but it remains an argument rather than a certainty. Clarify the computation basis with HR before the final settlement, while you still have leverage.

The two-year cap in practice

Total statutory gratuity cannot exceed two years' wages however long you serve; at standard accrual rates the cap binds after roughly twenty years. Long-service employees should check whether contractual enhancements sit inside or outside the cap, since the distinction is worth real money at senior levels. Confirm the current cap wording in Article 51 on uaelegislation.gov.ae before relying on it in any dispute.

# Gratuity vs contractual packages vs savings schemes

Three different things are often called "end of service", and home countries may tax each differently. First, statutory gratuity under Article 51 - the 21/30-day calculation above. Second, contractual enhancements: many employers top up the statutory amount, pay ex-gratia sums, or continue benefits for a period; these are employment income by another name. Third, workplace savings schemes: DIFC and ADGM employers typically use defined-contribution plans instead of classic gratuity, and some mainland employers offer voluntary savings top-ups. Each layer needs its own home-country characterisation - employment income, pension-like benefit, or capital sum - and the answer can differ between layers of the same payout. Ask HR for a breakdown by component before departure, because a single lump-sum figure on a payslip hides the distinctions your home filing needs.

DIFC and ADGM workplace savings

If you worked in the DIFC or ADGM, your "gratuity" is likely a workplace savings plan balance with employer and mandatory contributions plus investment growth. The contributions, the growth and the withdrawal can each have a different home-country treatment. Get the plan statements for every year, not just the final balance - home filings may need the contribution history.

Notice pay and accrued leave

Payment in lieu of notice and encashed annual leave are employment income, plain and simple, taxable in the year of receipt at home if you are resident then. They are often paid with the gratuity but are not gratuity - keep them separately identified on the final settlement for clean home reporting.

# How Sri Lanka taxes your payout

A UAE gratuity received while Sri Lankan non-resident is outside Sri Lankan tax in general terms; received after re-establishing residence, it may be employment income for that year. Sri Lanka has no verified special exemption for foreign end-of-service lump sums. Time the receipt against your residence position. General information only. The planning question is therefore not "is it taxed" but "in which year, and as what". A gratuity received while you are still non-resident for Sri Lanka purposes is generally outside Sri Lanka tax; the same dirhams received after re-registration at home can be taxable employment income of the receipt year. Where the amount is large, the year boundary is worth real money, and the difference between "paid in December while Dubai-resident" and paid in February after moving home" is entirely about documentation and timing. Discuss the payment schedule with your employer early: payroll can often work within a window of weeks, but cannot rewrite history after the settlement is booked. Home-country tax law is general information only. Tax rules in Sri Lanka change, and this guide cannot give personal advice on them. Confirm every home-country position with qualified local counsel in Sri Lanka before you act on it.

Averaging and spreading provisions

Some countries offer averaging or spreading relief for large employment-termination payments, taxing them as if received over several years. Whether Sri Lanka has such a mechanism, and whether a UAE gratuity qualifies, is a precise domestic-law question - but it is worth asking, because the saving can be material on a six-figure payout. Raise it with Sri Lanka counsel before the receipt year closes, since elections are often time-limited. General information only.

Currency and exchange-rate effects

Gratuity computed in dirhams and taxed at home in another currency creates an exchange-rate gain or loss between the entitlement date and the receipt or conversion date. Most systems tax the home-currency value at receipt, but the computation-date rules vary. Keep the central-bank rate evidence for the relevant dates; on large payouts the FX movement alone can shift the bill. Your Sri Lanka accountant will want the rate trail with the filing.

# Timing: take it before you move or after?

The table shows why the same payout produces five different answers: residence at receipt is the switch. None of these scenarios is aggressive - they are all just timing - but the difference between row one and row three is the difference between zero home tax and full home tax on the same money. That is why the conversation with HR happens before the farewell party, not after.

# Pension contributions and savings plans

Expatriates in the UAE are generally outside the UAE pension system (which covers Emiratis), so retirement provision is your own affair: voluntary savings plans, offshore pensions, or continued contributions to a Sri Lanka pension while abroad. Each has a home-country angle. Continued Sri Lanka pension contributions during Dubai years may or may not attract home tax relief depending on Sri Lanka rules for non-residents - confirm rather than assume. Withdrawals from foreign pension plans after returning home are typically taxable pension income there. And if you hold UAE-based savings or investment bonds, remember they become foreign-held assets at home on return, with whatever reporting that triggers. The theme is consistent: the Dubai years are not a holiday from retirement planning, they are the years when the paperwork is created. General information on Sri Lanka law only.

Continuing Sri Lanka pension contributions from Dubai

Some expats keep paying into home-country pensions while abroad to preserve contribution histories. Whether those contributions attract home tax relief as a non-resident depends entirely on Sri Lanka rules; in several countries the relief requires residence. Contributing without relief can still be rational for an employer match or the contribution record, but know which benefit you are actually buying. General information only.

Offshore savings bonds

UAE-based savings and investment bonds are invisible to UAE tax, but they become foreign-held assets on your return home, with reporting and possibly annual taxation of gains depending on Sri Lanka law. Surrender charges often make early exit expensive, so the keep-or-cash-out decision needs the plan's fee schedule and the home-country treatment side by side. Run that comparison before the move, not after.

# Documents your home accountant will ask for

Assemble this file before you leave Dubai; every item is harder to obtain from abroad. The gratuity computation sheet showing the 21/30-day maths and the basic wage used. The final payslip separating gratuity, notice pay, leave encashment and any ex-gratia amount. The employment contract and any enhancement letters. Bank credit advices proving receipt dates - the dates, not just the amounts, drive the residence analysis. For DIFC/ADGM savings plans, annual statements for every year plus the withdrawal statement. And your residence timeline: visa cancellation, travel records, new-country registration. Hand this file to your Sri Lanka accountant in one go; a complete file gets a clean filing, while a drip-feed of documents gets estimates and caveats.

If HR will not provide a breakdown

Some employers issue a single net figure. Push back in writing before signing the settlement: ask for the component breakdown citing your home-country filing obligations. If they refuse, reconstruct from the contract and prior payslips and note the reconstruction in your file - an explained estimate beats an unexplained lump sum.

# Payout scenarios at a glance

A five-year employee on AED 20,000 basic wage: gratuity is 21 days per year for five years, roughly 3.5 months of basic wage - about AED 70,000 before the two-year cap becomes relevant. A twelve-year employee on AED 30,000 basic: five years at 21 days plus seven years at 30 days, roughly 10.5 months of basic wage - about AED 315,000, still under the cap. These are illustrations of the statutory maths, not advice, and your contract may improve on them. The tax point is scale: at these amounts, the residence-at-receipt question is worth getting right, because home-country tax on a six-figure dirham payout is not a rounding error. Confirm the current Article 51 wording on uaelegislation.gov.ae before relying on the day counts in a dispute.

# Book a cross-border relocation tax review

Your end-of-service payout is probably the largest single sum your Dubai years produce - and the most time-sensitive to plan. Most Sri Lankan expats arrive in Dubai with two tax systems pulling in different directions, and the expensive mistakes all happen in the first year: a missed deregistration at home, a misunderstood residence test, a gratuity paid in the wrong tax year. A cross-border relocation tax review maps your UAE position - residency, corporate tax exposure, VAT, TRC eligibility - against a properly caveated home-country picture prepared with Sri Lanka counsel, so you file correctly in both places from day one. The review covers your arrival-year filings, the documents your home accountant will eventually ask for, and the timing decisions (bonus payments, property moves, business setup) that are cheap to get right now and expensive to fix later. It is fixed-scope, plain-language, and built for people who have just moved - not for tax departments. If you are still deciding whether the move makes sense, the review will tell you that too, honestly. Book the review before your first home-country filing deadline after arrival, because after that deadline the planning window for the arrival year is closed.

FAQ Answers to the questions people actually ask

Frequently asked questions

How is UAE gratuity calculated?

Under Federal Decree-Law No. 33 of 2021, employees with at least one year of service get 21 days of basic wage per year for the first five years and 30 days per year thereafter, capped at two years' total wages, with part-years pro rata. Basic wage excludes allowances unless your contract says otherwise. In the UAE the payout is received free of personal income tax. Always get HR's written computation and check the maths yourself.

Is my gratuity taxed in the UAE?

No. The UAE levies no personal income tax, so gratuity, notice pay, leave encashment and contractual top-ups are all received tax-free in the Emirates. Tax exposure, if any, sits in your home country and turns on your residence position when the money is received. That is why payment timing against your residence timeline is the central planning question.

Will Sri Lanka tax my Dubai gratuity?

A UAE gratuity received while Sri Lankan non-resident is outside Sri Lankan tax in general terms; received after re-establishing residence, it may be In practical terms: received while you are non-resident at home, it is generally outside home tax; received after re-registering at home, it can be taxable employment income of the receipt year. Discuss payment timing with your employer before departure. General information only - confirm with Sri Lanka counsel.

What is the two-year cap on gratuity?

Total statutory gratuity cannot exceed two years' wages, however long the service. In practice the cap rarely binds below about 20 years of service at standard accrual rates, but contractual enhancements can sit on top of the statutory amount - clarify with HR whether any top-up is inside or outside the cap calculation. Confirm current Article 51 wording on uaelegislation.gov.ae.

Are allowances included in the basic wage for gratuity?

No, unless your contract expressly includes them. The statute uses basic wage, and housing, transport and other allowances are excluded by default - a frequent source of disappointment at settlement. Check your contract's definition of basic wage now, not at exit; if the contract is ambiguous, clarify in writing before the final settlement is computed.

How are DIFC/ADGM savings plans taxed at home?

In the UAE, no personal tax applies. At home, the contributions, investment growth and withdrawal can each be characterised differently - employment income, pension-like benefit or capital sum - depending on domestic law. Get plan-level advice covering each component, keep annual statements for every year, and do not assume the headline withdrawal figure is the taxable amount. General information only.

Should I time my gratuity payment around my move?

Often yes, and it is legitimate timing rather than avoidance. Because home taxation turns on residence at receipt, a payout landing while you are still non-resident at home is treated differently from one landing after re-registration. Agree a payment window with HR early - payroll can usually flex by weeks, not rewrite history. Confirm the residence cut-off with home counsel first.

What documents do I need for my home tax filing?

The gratuity computation sheet, final payslip separating each component, employment contract and enhancement letters, bank credit advices proving receipt dates, DIFC/ADGM plan statements if relevant, and your residence timeline (visa cancellation, travel records, new registration). Assemble before leaving Dubai - every item is harder to obtain from abroad.

Is payment in lieu of notice taxed differently?

In the UAE, no - it is received tax-free like everything else. At home it is generally plain employment income of the receipt year, without any special lump-sum treatment. Keep it separately identified from gratuity on the final settlement so your home filing characterises each component correctly. General information only.

Can I split my payout across two tax years?

Sometimes, with employer agreement - for example, gratuity in December and a contractual top-up in January. Each tranche is then tested separately for residence and characterisation, which can smooth a large payout. This needs payroll cooperation arranged before departure and home-country confirmation that the split is respected. Do not attempt it unilaterally. General information only.
