how to dispute late vat return filing penalty uae
You can dispute the AED 1,000 penalty for late VAT return filing by filing a reconsideration request with the FTA within 40 business days of notification under Article 29 of Federal Decree-Law No. 28 of 2022. This guide covers every clock that runs on this penalty, in order. If reconsideration fails, you have 40 business days to object to the Tax Disputes Resolution Committee, whose decision takes 20 business days.

# Every deadline in a late VAT return filing penalty dispute
Four clocks can run on a late VAT return filing dispute, and missing any one of them usually ends the matter. Count only business days — Friday-to-Sunday weekends and UAE public holidays are excluded — and count from the notification date, not the date on the assessment letter.
Clock 1 — reconsideration: 40 business days from notification of the penalty assessment (Article 29). Clock 2 — the FTA's decision: 40 business days to decide, 5 to notify you (Article 29(2)). Clock 3 — TDRC objection: 40 business days from notification of the reconsideration decision, with the tax paid in full (Article 32). Clock 4 — court appeal: 40 business days from the Committee's decision, with 50% of penalties paid or guaranteed (Article 36).
# Counting business days without error
Start counting on the day after notification as day 1, skip Fridays, Saturdays and Sundays, and skip UAE public holidays (Eid, National Day, New Year and the Hijri holidays the government announces). Mark the deadline on two calendars and set reminders at 30, 20, 10 and 3 business days out. File at the 10-day mark, not the deadline — EmaraTax outages on the final day are your problem, not the FTA's.
If the deadline is already tight, ask for an extension under Article 35 / FTA Decision No. 1 of 2025 before it expires. Extensions are discretionary and far weaker when requested after the clock has run out.
The voluntary disclosure trap
Do not confuse the dispute clocks with the 20-business-day voluntary disclosure clock, which runs from when you became aware of an error. Disclosing and disputing are different routes: a disclosure admits the error and argues the penalty, while a dispute denies the assessment. Pick one deliberately.
# What missing a deadline costs
A late reconsideration request is inadmissible — the FTA will not hear the merits, however strong. A late TDRC objection fails under Article 32(2)(c), and the courts have no power to extend these statutory windows. The Dhruva analysis of the 2021 amendments notes expressly that any scope for condoning delay has been taken away.
If a deadline has already passed, the remaining options are narrow: the Article 50 instalment/waiver committee (which addresses payment, not the merits), or a fresh voluntary disclosure if a new error is found. | TDRC objection (Article 32) | 40 business days from notification of the reconsideration decision; tax must be paid in full | Committee decides in 20 business days, notifies in 5 |
| Court appeal (Article 36) | 40 business days from notification of the Committee decision; 50% of penalties secured | Court timetable applies |
# Building a deadline system that survives staff changes
The late VAT return filing dispute failed in many businesses not on the merits but because the 40-business-day clock lived in one person's head. Build the system so it survives resignations: a shared diary (not a personal calendar), every FTA notification logged with its screenshot and computed deadline on the day it arrives, and a weekly review where someone confirms nothing is within 10 business days without an owner. Name a backup for every deadline owner, and make the handover checklist include open disputes explicitly. For the AED 1,000 late VAT return filing penalty specifically, the critical dates are the notification date (prove it), the 40-business-day filing deadline (compute it on a calendar, excluding Fridays, Saturdays, Sundays, and UAE public holidays), and the FTA's 40+5 business-day decision window (diary the follow-up). Test the system twice a year with a dummy entry. A diary nobody checks is decoration; a diary someone owns is a control.

Frequently asked questions
How many days do I have to dispute a late VAT return filing penalty?
You have 40 business days from notification of the penalty assessment to file a reconsideration request under Article 29. Business days exclude weekends and UAE public holidays. Do not confuse this with the 20-business-day voluntary disclosure clock or the TDRC's 20-business-day decision time — three different clocks, three different numbers.
What happens if I miss the 40-day reconsideration deadline?
A late request is inadmissible and the FTA will not consider the merits. The statutory windows cannot be extended after expiry except through a discretionary Article 35 extension requested before the deadline. Your remaining route is usually the Article 50 instalment or waiver committee, which deals with payment terms rather than the rights and wrongs of the penalty.
Do weekends count in the 40 business days?
No. Business days exclude Fridays, Saturdays and Sundays plus UAE public holidays. Count day 1 as the day after notification. When in doubt, file early — a dispute filed on day 30 is identical in law to one filed on day 40, but infinitely safer.
