New Evidence at the Court Stage

Introducing fresh material on appeal article 36 appeals: 40 business days, the 50%-of-penalties security, and how the competent court decides.

new evidence court appeal tax

New evidence at court is possible but governed — the appeal is not an opportunity to rebuild the case from scratch. Courts admit new material under their procedural rules, typically where it is relevant, credible, and explains why it was unavailable earlier. The 'why now' explanation matters: evidence that existed but was not filed below needs a good reason, or it damages credibility instead of helping.

# The court appeal: how you get here

New evidence at court is possible but governed — the appeal is not an opportunity to rebuild the case from scratch.

Article 36 gives both the Authority and the taxpayer 40 business days from notification of the Committee's decision to appeal to the competent court, in two cases: objecting to the Committee's decision in whole or in part, or where the Committee issued no decision on a duly submitted objection. The court will rule the appeal inadmissible unless the full tax is paid and at least 50% of the administrative penalties is settled in cash or secured by an approved bank guarantee — Article 36(2).

# Introducing fresh material on appeal: the appeal

Courts admit new material under their procedural rules, typically where it is relevant, credible, and explains why it was unavailable earlier. The 'why now' explanation matters: evidence that existed but was not filed below needs a good reason, or it damages credibility instead of helping.

Practicalities

Where genuinely new material emerges (a foreign authority's delayed certificate, newly discovered records), present it promptly with the explanation. Where the material existed all along, consider whether its late arrival hurts more than its content helps.

# What the court can do, and what follows

The best new-evidence strategy is needing none: the complete administrative file makes the appeal self-sufficient. Treat every administrative filing as if the court will read it — because it will.

# Preparing the court appeal: what changes at this stage

Court is a different forum from everything before it, and the preparation must reflect that. Four things change:

The admissibility conditions are strict and checked first

Before the court reaches your arguments, it checks Article 36(2): was the appeal filed within 40 business days of the Committee's notification, is the full tax paid, and is at least 50% of the penalties settled in cash or secured by an approved bank guarantee? Fail any one and the appeal is inadmissible. Arrange the guarantee early — banks take weeks — and verify the tax payment has allocated correctly. Where genuinely new material emerges (a foreign authority's delayed certificate, newly discovered records), present it p...

The pleadings must be litigation-grade

Committee papers do not suffice. The court expects formal pleadings: the facts, the legal grounds with article references, and the remedy sought, each exhibit formally referenced and numbered. Engage litigation counsel — tax advisers who shone at reconsideration may not be advocates. The grounds should be reframed for a judge, not a committee: tighter, more formal, with the evidence chain explicit.

New evidence rules apply

Courts apply evidential standards the earlier forums do not. Ensure translations are certified, documents are properly exhibited, and the chain of custody is clear. Evidence the Committee saw informally must be re-presented formally. If new evidence emerged after the Committee stage, take advice on its admissibility before relying on it.

Settlement remains possible

Even at the court stage, settlement can be the rational outcome — particularly where the amount in dispute is modest against the cost of litigation, the guarantee tie-up, and management time. Assess settlement against the strength of the surviving grounds honestly, and keep the Article 50 instalment track in mind for whatever balance remains. A well-prepared appeal settles better than a weak one. Discuss settlement authority with the decision-makers before the hearing, not during it.

FAQ Answers to the questions people actually ask

Frequently asked questions

How long does a tax court case take?

Months, typically — court timetables run on hearings, expert appointments, and judgments, not the business-day clocks of the administrative ladder. Budget for a year or more for a contested appeal, and manage the 14%-per-annum interest on any unpaid balance in the meantime.

What does the 50%-of-penalties security actually cost?

Either the cash itself (paid to the FTA) or a bank guarantee's arrangement fees and collateral — for large penalties, the guarantee is usually cheaper than locking up cash, but it takes 2–4 weeks to arrange. Start in week 1; the security must exist within the 40-day window.

What new evidence do courts accept most readily?

Independent expert reports commissioned for the appeal, updated computations, and genuinely unavailable-earlier documents with a clear explanation. What courts resist is the case rebuilt from material that was available throughout — it suggests the administrative stages were not taken seriously.
