Transfer Pricing Appeals at Court
Litigating article 55 adjustments article 36 appeals: 40 business days, the 50%-of-penalties security, and how the competent court decides.
transfer pricing court appeal
Transfer-pricing appeals are the court's most technical tax cases — valuation methodology argued as law, through experts, to judges. The appeal tests the Committee's handling of the methodological battle: was the right method chosen, were the comparables sound, was the range properly applied. Expert evidence is central — the taxpayer's expert and (often) the authority's — and counsel must make methodology intelligible without dumbing it down.

# The court appeal: how you get here
Transfer-pricing appeals are the court's most technical tax cases — valuation methodology argued as law, through experts, to judges.
Article 36 gives both the Authority and the taxpayer 40 business days from notification of the Committee's decision to appeal to the competent court, in two cases: objecting to the Committee's decision in whole or in part, or where the Committee issued no decision on a duly submitted objection. The court will rule the appeal inadmissible unless the full tax is paid and at least 50% of the administrative penalties is settled in cash or secured by an approved bank guarantee — Article 36(2).
# Litigating Article 55 adjustments: the appeal
The appeal tests the Committee's handling of the methodological battle: was the right method chosen, were the comparables sound, was the range properly applied. Expert evidence is central — the taxpayer's expert and (often) the authority's — and counsel must make methodology intelligible without dumbing it down.
Practicalities
The expert strategy is set in week 1: the existing rebuttal report is the foundation, the court expert evidence builds on it, and the expert must withstand cross-examination. Methodology presentations — visual, clear, honest about ranges — decide these appeals.
# What the court can do, and what follows
TP appeals are long, expensive, and consequential — the judgment affects the group's future pricing. Litigate them as the strategic matters they are, with the economics explicitly modelled including the 14% interest over the appeal's duration.

# Preparing the court appeal: what changes at this stage
Court is a different forum from everything before it, and the preparation must reflect that. Four things change:
The admissibility conditions are strict and checked first
Before the court reaches your arguments, it checks Article 36(2): was the appeal filed within 40 business days of the Committee's notification, is the full tax paid, and is at least 50% of the penalties settled in cash or secured by an approved bank guarantee? Fail any one and the appeal is inadmissible. Arrange the guarantee early — banks take weeks — and verify the tax payment has allocated correctly. The expert strategy is set in week 1: the existing rebuttal report is the foundation, the court expert evidence builds o...
The pleadings must be litigation-grade
Committee papers do not suffice. The court expects formal pleadings: the facts, the legal grounds with article references, and the remedy sought, each exhibit formally referenced and numbered. Engage litigation counsel — tax advisers who shone at reconsideration may not be advocates. The grounds should be reframed for a judge, not a committee: tighter, more formal, with the evidence chain explicit.
New evidence rules apply
Courts apply evidential standards the earlier forums do not. Ensure translations are certified, documents are properly exhibited, and the chain of custody is clear. Evidence the Committee saw informally must be re-presented formally. If new evidence emerged after the Committee stage, take advice on its admissibility before relying on it.
Settlement remains possible
Even at the court stage, settlement can be the rational outcome — particularly where the amount in dispute is modest against the cost of litigation, the guarantee tie-up, and management time. Assess settlement against the strength of the surviving grounds honestly, and keep the Article 50 instalment track in mind for whatever balance remains. A well-prepared appeal settles better than a weak one. Discuss settlement authority with the decision-makers before the hearing, not during it.

Frequently asked questions
Can I settle with the FTA during the court appeal?
Settlement remains possible — and courts often encourage it. A settlement needs authority on both sides and should address the tax, the penalties, and the interest together. Do not let settlement talks consume the procedural timetable; protect the case while talking.
Will the court rehear all the evidence?
Courts review the case on the record with their own procedural rules on new evidence — they are not a complete retrial of the audit. The administrative file (reconsideration, objection, Committee decision) frames the appeal; new material must meet the court's admissibility standards.
What decides transfer pricing appeals?
Methodological credibility: the sounder method, the better comparables, the more honest range. Courts cannot re-audit the business, so they judge the analyses — the analysis that shows its working, acknowledges its limits, and fits the facts wins.
