Court Appeal Against a VAT Assessment
Appealing vat assessments to court article 36 appeals: 40 business days, the 50%-of-penalties security, and how the competent court decides.
court appeal vat assessment
A VAT assessment that survived reconsideration and the TDRC can be appealed to the competent court within 40 business days where the total exceeds AED 100,000. The court appeal reframes the case legally: the Committee's reasoning is tested for legal error, the methodology for rationality, the computation for correctness. VAT appeals often center on classification, place of supply, or input VAT — questions courts can decide on the documentary record without re-auditing.

# The court appeal: how you get here
A VAT assessment that survived reconsideration and the TDRC can be appealed to the competent court within 40 business days where the total exceeds AED 100,000.
Article 36 gives both the Authority and the taxpayer 40 business days from notification of the Committee's decision to appeal to the competent court, in two cases: objecting to the Committee's decision in whole or in part, or where the Committee issued no decision on a duly submitted objection. The court will rule the appeal inadmissible unless the full tax is paid and at least 50% of the administrative penalties is settled in cash or secured by an approved bank guarantee — Article 36(2).
# Appealing VAT assessments to court: the appeal
The court appeal reframes the case legally: the Committee's reasoning is tested for legal error, the methodology for rationality, the computation for correctness. VAT appeals often center on classification, place of supply, or input VAT — questions courts can decide on the documentary record without re-auditing.
Practicalities
Instruct litigation counsel in week 1; arrange the 50%-of-penalties security in parallel (2–4 weeks). The appeal draft should lead with the legal error in the Committee's decision, supported by the documentary record built below.
# What the court can do, and what follows
The court can uphold, vary, or annul the decision, with further appeal routes under the court system's rules. Interest at 14% per annum continues on unpaid balances during the appeal — factor it into settlement thinking.

# Preparing the court appeal: what changes at this stage
Court is a different forum from everything before it, and the preparation must reflect that. Four things change:
The admissibility conditions are strict and checked first
Before the court reaches your arguments, it checks Article 36(2): was the appeal filed within 40 business days of the Committee's notification, is the full tax paid, and is at least 50% of the penalties settled in cash or secured by an approved bank guarantee? Fail any one and the appeal is inadmissible. Arrange the guarantee early — banks take weeks — and verify the tax payment has allocated correctly. Instruct litigation counsel in week 1; arrange the 50%-of-penalties security in parallel (2–4 weeks). The appeal draft s...
The pleadings must be litigation-grade
Committee papers do not suffice. The court expects formal pleadings: the facts, the legal grounds with article references, and the remedy sought, each exhibit formally referenced and numbered. Engage litigation counsel — tax advisers who shone at reconsideration may not be advocates. The grounds should be reframed for a judge, not a committee: tighter, more formal, with the evidence chain explicit.
New evidence rules apply
Courts apply evidential standards the earlier forums do not. Ensure translations are certified, documents are properly exhibited, and the chain of custody is clear. Evidence the Committee saw informally must be re-presented formally. If new evidence emerged after the Committee stage, take advice on its admissibility before relying on it.
Settlement remains possible
Even at the court stage, settlement can be the rational outcome — particularly where the amount in dispute is modest against the cost of litigation, the guarantee tie-up, and management time. Assess settlement against the strength of the surviving grounds honestly, and keep the Article 50 instalment track in mind for whatever balance remains. A well-prepared appeal settles better than a weak one. Discuss settlement authority with the decision-makers before the hearing, not during it.

Frequently asked questions
What are the chances of winning a tax court appeal?
It depends on the record built below: courts give weight to the TDRC's reasoning, so an appeal that merely repeats the objection rarely succeeds. New evidence admissible under court procedures, a clear legal error in the Committee's decision, or a methodology demonstrably wrong — those are the grounds that move courts.
What happens to the TDRC decision while the appeal runs?
The appeal does not automatically suspend enforcement — the decision's executory character must be addressed specifically. Take advice on protective measures within the appeal; assuming the appeal alone stops enforcement is a common and costly error.
Should the VAT appeal attack the facts or the law?
Both, but lead with law: the Committee's legal conclusions (classification, place of supply) are more appealable than its factual impressions. Factual attacks need new admissible evidence or a demonstrable irrationality in the findings.
