# TDRC objection for E-commerce Sellers: The payment condition
E-commerce disputes are data disputes: whether taxable supplies crossed AED 375,000, how refunds and marketplace fees net out, and where the place of supply sits for cross-border sales. Estimated assessments are common because the FTA cannot see the platform data — so bring the platform data.
Article 32(2)(b) makes an objection inadmissible unless the tax connected with it has been paid in full. For e-commerce sellers, marketplace sales, refunds, and cross-border supplies make the VAT threshold math genuinely hard — and the FTA's estimate may be harder. Read the condition carefully: it is the tax that must be settled, not the administrative penalties — the distinction that keeps objections affordable in penalty-heavy disputes.
# What matters most
Pay the connected tax before filing and attach the proof to the objection — EmaraTax payment reference, bank confirmation, allocation showing which assessment it settles. If the underlying tax is already paid or nil, no further payment is needed; say so explicitly with the ledger attached.
Where the tax itself is genuinely disputed and large, the 50%-of-penalties-plus-full-tax security at the later court stage is the heavier burden — plan for it now if the amount exceeds AED 100,000.
# After the objection
With the tax paid and the objection filed within 40 business days, the Committee decides within 20 business days. If the deadline is close or the amount is large, get help before you file. # Paying the connected tax: mechanics for E-commerce Sellers
The Article 32(2)(b) payment condition is mechanical, but the mechanics matter. For e-commerce sellers: Get the payment mechanics right and the admissibility question disappears, leaving the Committee free to decide your grounds on their merits. It is the least intellectually demanding part of the objection — and the most commonly botched.
What exactly must be paid
The tax connected with the objection — in full. Not the penalties (those stay payable only if the dispute fails, or secured at 50% for court), not a related period's balance, not an estimate. Read the assessment and the reconsideration decision to identify the precise tax figure under challenge. For e-commerce sellers, marketplace sales, refunds, and cross-border supplies make the VAT threshold math genuinely hard — and the FTA's estimate may be harder. If multiple assessments are under objection, each connected tax must be settled.
How to pay and prove it
Pay through EmaraTax so the payment links automatically to the tax account, and keep the payment reference. Add the bank confirmation showing the value date, and write a one-paragraph allocation note: this payment of AED X on [date] settles the tax of AED X assessed under [reference]. Attach all three to the objection file. A payment the Committee cannot trace to the assessment is as bad as no payment for admissibility purposes.
Timing the payment inside the 40 days
Initiate the payment in the first week of the objection window — bank processing, internal approvals, and EmaraTax allocation all take time you do not have in week eight. Verify the payment has landed and allocated before filing the objection; a filed objection with a payment still 'in transit' is a gamble. Open with the data methodology: which platform, which report, how refunds/fees were treated, the resulting monthly taxable-supplies schedule. Reviewers trust transparent methodology over bare totals.
When the tax figure itself is the dispute
Pay under protest and say so: the payment unlocks the Committee, and paying does not concede the merits — the Committee can still vary or cancel the assessment. An inadmissible objection for want of payment helps no one, however strong the grounds. If cash flow makes full payment genuinely impossible, take advice urgently on whether any alternative exists — but do not assume one does.

Frequently asked questions
Must e-commerce sellers pay the tax before objecting to the TDRC?
Yes — the tax connected with the objection must be paid in full, and the objection is inadmissible without it (Article 32(2)(b)). The administrative penalties need not be paid at this stage. Attach the payment proof to the objection file.
What if the tax amount itself is disputed?
Pay it anyway to unlock the TDRC, under protest and with the dispute continuing — an inadmissible objection helps no one. The payment does not concede the merits; the Committee can still vary or cancel the assessment.
Do penalties need to be paid for a TDRC objection?
No. Only the connected tax must be paid in full at the objection stage. The penalties security — at least 50% by cash or bank guarantee — applies only if the case proceeds to the competent court under Article 36.
