Energy-Intensive Manufacturing: Disclosure Notes
Fuel and power inputs, self-generation, and carbon-adjacent incentives each need analysis in the manufacturing disclosure.
energy-intensive manufacturing: disclosure notes
Energy-intensive manufacturers analyse three lines in the disclosure: fuel and power input VAT recovery with the valid-invoice evidence, self-generation (solar, generators) with the capitalisation and supply analysis, and any energy incentives or grants with the tax treatment analysed (confirm the current incentive positions on tax.gov.ae). Energy is a large cost line — the input VAT schedule's energy section is material on its own.

# What the rules say
Cross-border supply chains add the customs-VAT layer: raw materials imported with under-declared values, finished goods exported with the export evidence missing, goods moved between the UAE plant and foreign affiliates with the transfer pricing and customs values unaligned. The disclosure anchors on customs declarations per consignment, proves exports with movement evidence, and aligns the transfer pricing analysis with the customs values — the three analyses must converge. Coordinate the VAT, excise (where relevant), and corporate tax corrections from the shared supply-chain facts.
# How to handle it in practice
Scrap, by-products, and waste sales are the revenue most often missed: offcuts sold to dealers, by-products sold without invoicing, waste collected for payment — all taxable supplies, routinely off-book. The disclosure quantifies the scrap and by-product revenue per affected period from weighbridge records, dealer statements, and production yields, correcting output VAT and the corporate tax revenue line together. Production yields imply the scrap population; the disclosure shows the yield analysis so the quantification is method-driven, not estimated.
# Documents to prepare before you open EmaraTax
A disclosure is only as strong as its evidence. Before starting the form, assemble the discovery memo (what was found, when, by whom), the original filed figures for each affected period, the corrected figures with a clear reconciliation between the two, and the source documents behind the correction — tax invoices, contracts, bank statements, import declarations, or payroll records as the error type requires. Keep everything for at least five years: Article 3 of Cabinet Decision No. 74 of 2023 (the Executive Regulation of the Tax Procedures Law) requires tax records to be retained for five years after the end of the relevant tax period (seven years for corporate tax under Article 56 of Federal Decree-Law No. 47 of 2022), and the FTA can ask to see the file behind any disclosure inside that window. A complete, dated file also protects you if the same error is ever questioned again — you can show exactly what was disclosed and when.
# The five-year window behind every disclosure
Errors do not expire quickly. Tax records must be kept for five years after the end of the relevant tax period, and the FTA's assessment powers run on a similar horizon — longer where evasion is suspected. Practically, this means a voluntary disclosure should sweep every affected period inside the window, not just the most recent one: correcting 2025 while leaving the same 2023 error in place invites the FTA to find the older one itself, at which point the voluntary route is closed for that period. When you discover an error, ask whether the same mistake happened in earlier periods before you file — one complete disclosure covering all affected periods is cheaper and safer than a drip-feed of corrections.

Frequently asked questions
Can input VAT be recovered on fuel and power?
Where the recovery conditions are met with valid tax invoices and the use supports taxable supplies — the business-use analysis per energy line. Your disclosure shows the energy input VAT schedule separately; bulk-claimed utilities without the analysis are the error.
What are the most common manufacturing tax errors?
Inventory valuation errors, unreported scrap and by-product sales, contract-manufacturing mischaracterisation, under-declared import values, and missing export evidence. Each repeats every period — fix the process analysis once, correct the full history. The disclosure corrects the history; the documented control fix prevents its repeat — do both in the one filing.
How do you disclose manufacturing errors?
With the production-to-sales reconciliation per period as the anchor: production records to sales ledger to returns, the inventory workings, and the process analyses. File within 20 business days of the production review that found the error. Build the evidence file before filing: verification tests the reconciliation line by line, and the complete file is what passes.
How is scrap revenue treated for tax?
As taxable supplies — scrap and by-product sales are revenue for VAT output tax and corporate tax alike. Quantify from weighbridge records, dealer statements, and yield analysis; off-book scrap is unreported income with a production trail. Keep the source documents that prove each corrected figure — the FTA verifies disclosures against primary records, not summaries.
What is tolling for VAT purposes?
The characterisation of the contract-manufacturing arrangement under the VAT rules — who supplies what to whom. Confirm the current position on tax.gov.ae for your arrangement structure; mischaracterised tolling is a multi-year, multi-tax error. Confirm the current position on tax.gov.ae before filing — guides move, and the filing must reflect the position as it stands.
What about imports of raw materials?
Anchor on the customs declarations per consignment: values, procedures, and the VAT treatment, reconciled to the purchase ledger. Under-declared values are among the most discoverable errors — disclose within the window. Miss the window and the 1% monthly voluntary disclosure penalty keeps running until you file, and an audit notice issued first adds a fixed 15% of the tax difference (Cabinet Decision No. 40 of 2017 as amended; No. 75 of 2023 for corporate tax) — the window is the cheapest route.
What is the disclosure deadline for manufacturers?
Twenty business days from awareness where the understatement exceeds AED 10,000 (Article 10, Cabinet Decision No. 74 of 2023; an error of AED 10,000 or less is corrected in the next tax return instead) — awareness being when the production, stock-count, or cost review identified the error. Batch reviews mean batch clocks; date each memo to its review. Calendar the 20-business-day deadline from the discovery memo date, and file by day 15 so the final days are buffer, not work time.
