Reconsideration After Audit: Building the Challenge
Challenge the assessment's facts and law within 40 business days, argued from the audit file's evidence — not from grievance.
reconsideration after audit: building the challenge
The post-audit reconsideration challenges the assessment or penalty decision on facts and law within 40 business days of notification: identify each disputed line in the assessment's workings, marshal the evidence (the audit file's reconciliations, source documents, and analyses), and argue each point precisely. The disclosure-quality file built earlier becomes the evidence base — build once, use twice.

# What the rules say
The reconsideration route is the post-audit remedy: within 40 business days of notification of the assessment or penalty decision, challenge it on facts and law with the audit file as the evidence base. This is a different discipline from disclosure — it argues the Authority's decision rather than correcting your figures — and it needs the decision's workings analysed line by line the day the decision arrives. Do not let the 40 days be consumed by disappointment; calendar the deadline from the notification date and start the analysis immediately.
# How to handle it in practice
The file discipline through audit and beyond: keep the audit correspondence, information requests and responses, the assessment and its workings, the reconsideration filing if made, and the related disclosures' files — all for five years, organised as one matter file. The audit is not the end of the story; it is the most documented chapter. A complete matter file is what makes the next review — by the FTA, by advisers, by buyers — a verification rather than an excavation.
# Disclosure, amendment, and reconsideration: which remedy fits
Three different tools fix three different problems, and using the wrong one wastes weeks. An amendment corrects a return that has not yet been filed or is still within its filing window — if you spot the mistake before submitting, just file the return correctly. A voluntary disclosure corrects a return, assessment, or refund claim that is already filed and wrong: you tell the FTA about your own error within 20 business days of discovering it (where it understated tax by more than AED 10,000; smaller errors go in the next return). A reconsideration challenges an FTA decision you disagree with — an assessment, a penalty, a rejected refund — and it runs on a completely separate 40-business-day clock from the date you are notified of the decision, under Article 29 of Federal Decree-Law No. 28 of 2022. Filing a reconsideration does not correct your return, and filing a disclosure does not challenge a decision. Pick the tool that matches your situation before the shorter of the two clocks runs out.
# Documents to prepare before you open EmaraTax
A disclosure is only as strong as its evidence. Before starting the form, assemble the discovery memo (what was found, when, by whom), the original filed figures for each affected period, the corrected figures with a clear reconciliation between the two, and the source documents behind the correction — tax invoices, contracts, bank statements, import declarations, or payroll records as the error type requires. Keep everything for at least five years: Article 3 of Cabinet Decision No. 74 of 2023 (the Executive Regulation of the Tax Procedures Law) requires tax records to be retained for five years after the end of the relevant tax period (seven years for corporate tax under Article 56 of Federal Decree-Law No. 47 of 2022), and the FTA can ask to see the file behind any disclosure inside that window. A complete, dated file also protects you if the same error is ever questioned again — you can show exactly what was disclosed and when.

Frequently asked questions
What makes a reconsideration succeed?
Precision: each disputed figure identified, each with its evidence and its legal basis, argued cleanly. The scattergun reconsideration disputing everything persuades on nothing; the targeted one disputing the provably wrong lines, with the file behind each, is the one that moves decisions.
Can you file a voluntary disclosure during an FTA audit?
Not usefully for the audited periods — the voluntary route is closed once the FTA is examining them, and a parallel filing can complicate the audit. Related errors outside the audit's scope (other periods, taxes, entities) may still be disclosable under their own 20-day clocks; triage the scope the day the notice arrives.
What should you do the day the audit notice arrives?
Triage the scope precisely (person, taxes, periods, subject matter), freeze the records, engage a tax agent, and identify any related errors outside the scope for immediate disclosure assessment. Do not file reflexive disclosures for audited periods; do disclose what remains yours to disclose.
Does the audit notice start disclosure clocks?
For related errors it can — the notice and its information requests often create awareness of errors outside the audit's scope, starting their 20-business-day clocks. That is why scope triage must be immediate: the related disclosures' windows open the day the notice lands.
What if you were about to disclose when the notice arrived?
Take professional advice immediately rather than filing into the audit — the prepared workings become the audit engagement file, but the filing decision needs advice. Never backdate anything to suggest pre-notice filing; portal timestamps are authoritative. Where the analysis is uncertain, engage a tax agent early — the professional fee is the smallest line with the largest leverage.
What is the remedy after an unfair assessment?
Reconsideration within 40 business days of notification of the assessment or penalty decision, argued on facts and law with the audit file as evidence. Calendar the deadline from the notification date and analyse the decision's workings line by line immediately.
Should related entities disclose during the audit?
Where the audit reveals systematic errors shared by sister entities or periods outside the scope, disclose those related errors promptly under their own clocks — coordinated with a tax agent. The audit team notices whether the group cleaned house. Sweep every affected period in the one filing — the error class always repeats, and partial scope is an incomplete disclosure.
