Penalties & Disputes
Which Remedy Checklist: Amend, Disclose, or Reconsider?
One-paragraph test: not filed — amend; your error on record — disclose in 20 days; their decision disputed — reconsider in 40.
which remedy checklist: amend, disclose, or reconsider
Run this test: is the return filed? No — amend by filing correctly. Yes, and the error is yours — file a voluntary disclosure within 20 business days of awareness under Article 10. Has the FTA issued a decision you dispute — assessment, penalty, rejected refund — request reconsideration within 40 business days of notification under Article 29.

# What the rules say
The practical test fits in one paragraph. Is the return filed? No — amend by filing correctly. Yes, and the error is yours — disclose within 20 business days of awareness. Has the FTA issued a decision you dispute — assessment, penalty, rejection — reconsider within 40 business days of notification. Write down which door you chose and why, with the deadline calendared: the file note that records the reasoning is the same discipline as the discovery memo, and it protects you if the choice is ever questioned.
# How to handle it in practice
The doors do not substitute for each other, and this is where businesses lose time. Filing a voluntary disclosure does not challenge a penalty the FTA already assessed — the assessed penalty needs reconsideration within its 40 days. Requesting reconsideration does not correct an error in your return — the error needs disclosure within its 20 days. And neither filing extends the other's deadline: the clocks run independently from different start events (awareness versus notification). Map your situation to the right door before either clock runs out.
# Disclosure, amendment, and reconsideration: which remedy fits
Three different tools fix three different problems, and using the wrong one wastes weeks. An amendment corrects a return that has not yet been filed or is still within its filing window — if you spot the mistake before submitting, just file the return correctly. A voluntary disclosure corrects a return, assessment, or refund claim that is already filed and wrong: you tell the FTA about your own error within 20 business days of discovering it (where it understated tax by more than AED 10,000; smaller errors go in the next return). A reconsideration challenges an FTA decision you disagree with — an assessment, a penalty, a rejected refund — and it runs on a completely separate 40-business-day clock from the date you are notified of the decision, under Article 29 of Federal Decree-Law No. 28 of 2022. Filing a reconsideration does not correct your return, and filing a disclosure does not challenge a decision. Pick the tool that matches your situation before the shorter of the two clocks runs out.
# Seven mistakes that invalidate a voluntary disclosure
Most rejected or wasted disclosures fail for avoidable reasons. First, filing under the wrong taxable person or TRN, common in groups. Second, missing the 20-business-day window — day 21 is late. Third, disclosing only part of the error while the books still hide the rest; a partial disclosure that the FTA later completes for you reads as concealment. Fourth, entering new wrong figures, which can require a second disclosure and damages credibility. Fifth, attaching illegible or incomplete documents, which stalls processing and can lead to the figures being questioned. Sixth, filing the disclosure after an audit notice has already arrived — once the FTA is examining the period, the voluntary character of the disclosure is gone. Seventh, forgetting to pay: the disclosure corrects the record, but disclosed tax still unpaid 20 business days after filing starts the 14% per annum late-payment penalty, which runs monthly until the money reaches the FTA. Check all seven before you submit.

Frequently asked questions
What is the single most common remedy mistake?
Filing a voluntary disclosure to fight an assessed penalty — the disclosure corrects figures, it does not challenge decisions, so the 40-day reconsideration window quietly expires while the business waits for the disclosure to 'work'. Match the remedy to the problem before any clock runs out.
What is the difference between amendment and voluntary disclosure?
An amendment corrects a return before it is filed or while the filing window is open — you simply file correctly. A voluntary disclosure corrects a return, assessment, or refund claim already on the FTA's record, within 20 business days of becoming aware of the error under Article 10 (where the understatement exceeds AED 10,000; smaller errors go in the next return). Before filing: amend. After filing and wrong: disclose.
What is the difference between voluntary disclosure and reconsideration?
Voluntary disclosure (Article 10) corrects your own error within 20 business days of awareness. Reconsideration (Article 29) challenges an FTA decision within 40 business days of notification. Disclosure fixes your figures; reconsideration disputes their decision. Neither filing extends the other's deadline.
Can a voluntary disclosure cancel an FTA penalty?
No — a disclosure corrects your return; it does not challenge a decision. An assessed penalty you consider wrong needs the reconsideration route within 40 business days of notification. File the disclosure for the error and the reconsideration for the penalty as separate remedies on separate clocks.
When should you request reconsideration instead of disclosing?
When the FTA has issued a decision you dispute — an assessment, a penalty, a rejected refund — and your argument is with their decision rather than your figures. If your own filed figures are wrong, disclose first; if their decision is wrong, reconsider. Sometimes, in sequence, both.
What is an FTA private clarification?
A request asking the FTA how the law applies to your facts. It is guidance, not a decision: it cannot be reconsidered under Article 29 and it corrects nothing. Do not confuse it with the three remedies — and do not let seeking one consume a running 20-day disclosure window.
You disagree with an assessment and your return was also wrong — what first?
Disclose your error within its 20 business days and separately reconsider the assessment within its 40 business days of notification. The disclosure corrects your figures (which may change what the assessment should have been); the reconsideration challenges the decision. Run both tracks; neither waits for the other.
