Pension Transfer Tax Guidance UAE: Foreign Pensions, Gratuity and Treaties
Drawing or moving a foreign pension as a UAE resident: no UAE pension tax, UK transfer charges, gratuity and treaty positions mapped before you act.
pension transfer tax uae
The UAE does not tax pension income, pension transfers or retirement savings held by individuals, and it provides no state pension for expatriates — your end-of-service gratuity is the local retirement benefit. The tax cost of moving a pension therefore sits almost entirely in the home country: transfer charges, exit rules and treaty articles decide the bill. TaxAdvisors maps both sides before you move anything.
Basis: GPSSA
- UAE tax on pensions
- No UAE tax on foreign pension income received by an individual, and no tax on transferring savings
- State pension cover
- The GPSSA scheme covers UAE nationals (and GCC nationals under the regional extension system); expatriates build private provision plus gratuity
- End-of-service gratuity
- 21 days of basic wage for each of the first five years of service and 30 days for each year after, under the Labour Law formula
- UK overseas transfer charge
- A 25% charge can apply to transfers into overseas pension schemes unless an exclusion fits — the analysis is fact-specific
- US position
- There is no social security totalisation agreement between the UAE and the United States; US citizens remain taxable by the US worldwide

# The UAE position on pensions, plainly
Residents ask two opposite questions about pensions: will the UAE tax mine, and will the UAE give me one? The answers are no, and no. Pension income arriving from abroad — a UK scheme pension, an occupational annuity, a personal pension drawdown — is not taxed in the UAE, because the UAE levies no income tax on individuals at all. Equally, there is no UAE state pension waiting for an expatriate: the federal pension authority, the GPSSA, covers UAE nationals, with GCC nationals covered under the regional insurance-extension system. Your local retirement provision is your end-of-service gratuity plus whatever you build privately. Pension tax guidance for a UAE resident is therefore cross-border by definition: the UAE side is a blank page, and every number that matters is written by the home country.
Gratuity: the benefit that replaces a pension here
Under Article 51 of the Labour Law, end-of-service gratuity accrues at 21 days of basic wage for each of the first five years of service and 30 days of basic wage for each additional year. One caution standard summaries miss: accrual is computed on basic wage, while the two-year overall cap in the same article is worded on 'wage', a wider definition — so large entitlements deserve their own cap calculation. DIFC employees sit under a different system again: the DIFC's mandatory workplace savings plan (DEWS) replaced gratuity accrual there in 2020.
Foreign pension income while UAE-resident
Receiving a pension in the UAE does not create UAE tax, but it does not switch off home-country tax by itself. What switches it off — where anything does — is the double taxation treaty between the UAE and the paying country, most of which assign taxing rights over private pensions to the country of residence. Claiming that treatment needs evidence of UAE tax residence — a tax residency certificate and a documented move history — assembled before the first payment is mis-taxed, not after.
# Who this guidance is built for
Pension tax outcomes turn on the combination of scheme type, home country and timing. The profiles below cover the situations we are asked about most; each one has a different trap.
| Profile | Core question | What we handle |
|---|---|---|
| UK pension holder considering a transfer | Does moving the scheme trigger the 25% overseas transfer charge, and is a transfer even the right move? | Transfer-charge analysis, QROPS status check, treaty position on future income, sequencing against residency |
| Retiree drawing a foreign pension in the UAE | Why is the home country still deducting tax, and can the treaty stop it? | Residence evidence, tax residency certificate, treaty claim paperwork with the paying scheme |
| Employee leaving UAE service | How do gratuity, DEWS and offshore pensions fit together at exit? | Gratuity calculation check, exit-year residency position, consolidation map for scattered schemes |
| US citizen resident in the UAE | What do the IRS and Social Security still claim? | Worldwide-tax reality check, reporting duties (FBAR/FATCA), no-totalisation planning for contribution gaps |
| Expat planning to leave the UAE | What happens to pension tax if I move on or go home? | Exit sequencing, re-entry rules of the next country, avoiding a taxable transfer in a transition year |
# The UK transfer question in detail
For British expatriates, the transfer decision dominates everything else, and it is governed by UK rules, not UAE ones. A transfer from a UK registered scheme to an overseas scheme is tested against the overseas transfer charge: 25% of the amount transferred, unless an exclusion applies — broadly, where the scheme is in the same country as your residence, an occupational scheme of your employer, or another narrow category. There is no UAE-based recognised overseas pension scheme to transfer into, so a UAE resident's transfer normally routes to a scheme in a third jurisdiction, and the exclusion analysis — not the brochure — decides whether it costs a quarter of the fund. The charge can also be clawed back if your circumstances change within five years of the transfer. Layered on top are the member payment rules, the receiving scheme's reporting to HMRC, and the UK–UAE treaty's treatment of the eventual pension income. We run that full analysis before any transfer form is signed — including the cases where the right answer is to leave the pension exactly where it is.
# How a pension tax review runs
The sequence matters: residency evidence first, transfer decisions second, paperwork last. Moving money before the map exists is how the 25% charges happen.
-
Scheme and country inventory
We list every pension and retirement account you hold — UK schemes, offshore schemes, 401(k) or IRA accounts, local gratuity and DEWS balances — with values, paying countries and governing rules.
-
Residency and treaty analysis
We establish your tax residence position in the UAE and each paying country, read the treaty articles governing your pension income, and identify the evidence — including a tax residency certificate — each payer requires.
-
Transfer-charge testing
If a transfer is on the table, we test it against the overseas transfer charge and its exclusions, model the five-year clawback window, and compare the after-charge outcome with leaving the scheme in place.
-
Sequencing plan
You receive an ordered plan: what to claim, what to transfer, what to leave alone, and in which tax years — coordinated with any planned move into or out of the UAE.
-
Coordination and documentation
Transfers themselves are executed by the schemes and, where advice is regulated, by authorised pension advisers; our deliverable is the tax analysis and the file that supports every step taken.
# Records and evidence that carry the position
Pension tax disputes are evidence disputes. Keep scheme valuations and transfer paperwork permanently, residency evidence — leases, entry and exit records, utility accounts — for every year you claim UAE residence, plus the correspondence behind any treaty claim. Certificates are issued year by year through the FTA, and payers abroad want the one matching the year of payment. We build the file as part of the engagement so that a question from HMRC, the IRS or a scheme administrator is answered from a folder, not from memory.
# Start with the map, not the transfer
If you hold pensions in more than one country, are drawing income that is still being taxed at source, or are being sold a transfer, the valuable next step is a written map of your position. TaxAdvisors will inventory your schemes, test the treaty and transfer-charge positions, and sequence the moves. This page is tax guidance, not regulated financial or pension advice: we do not recommend schemes, funds or transfers, and execution sits with the schemes and authorised advisers. TaxAdvisors is a tax advisory practice — it is not on the FTA tax agent register and is not a registered auditor. Call +971 58 541 4616, WhatsApp https://wa.me/971585414616, or email info@taxadvisors.ae. Fees depend on the number of schemes and countries involved; we quote in writing after the inventory call.

Frequently asked questions
Is my foreign pension taxed in the UAE?
No. The UAE levies no income tax on individuals, so pension income paid to you from abroad — UK, European, American or elsewhere — arrives free of UAE tax, and there is no UAE return to file for it. Whether the paying country may still tax it depends on the double taxation treaty between that country and the UAE and on your documented residence position — the part worth getting right in writing.
Can I transfer my UK pension to the UAE?
Not into a UAE scheme — there is no UAE-based recognised overseas pension scheme (QROPS) to receive it. Transfers normally route to recognised schemes in third jurisdictions, and each one must be tested against the UK's overseas transfer charge, which can take 25% of the fund if no exclusion applies. For many residents the better answer is to leave the scheme in place and manage the income position instead.
What is the overseas transfer charge?
It is a UK tax charge of 25% on transfers from UK registered pension schemes to overseas schemes where no exclusion fits — for example where the receiving scheme is in your country of residence or is your employer's occupational scheme. The charge can also arise retrospectively if your circumstances change within five years of a clean transfer. It is assessed on the transfer value, and on a large fund it dwarfs every other cost in the decision.
How is end-of-service gratuity calculated in the UAE?
Under Article 51 of the Labour Law, gratuity accrues at 21 days of basic wage for each of the first five years of service and 30 days of basic wage for each year after that, pro-rated for partial years. The accrual runs on basic wage, while the overall cap of two years is worded on the wider definition of wage — a detail that matters on large entitlements. DIFC employees are under the DEWS savings plan instead of gratuity. No UAE tax applies to the payment.
I am a US citizen. Does living in the UAE change my pension tax?
Much less than you might hope. The United States taxes its citizens on worldwide income wherever they live, there is no social security totalisation agreement between the US and the UAE, and US reporting duties such as FBAR and FATCA continue. Your 401(k) and IRA accounts remain US-taxed under US rules. The UAE adds no tax of its own — but it removes none of the American layer either.
Should I transfer my pension before or after becoming UAE tax resident?
Sequencing is often the whole decision. The overseas transfer charge exclusions turn on your residence when the transfer happens, treaty claims on pension income need residence evidence for the year of payment, and a transfer executed in a transition year can be tested by two countries at once. The safe order is: establish and document UAE residence, run the charge analysis on your facts, then decide. A transfer done in the wrong order cannot be re-sequenced afterwards.
