# How the reverse charge works for oil & gas

Under Article 48 of the VAT Law, where a UAE business receives services from a non-resident supplier, the recipient self-accounts for the VAT: it declares 5% output tax on the value of the services and, where they are used for making taxable supplies, recovers the same amount as input tax. The foreign supplier does not charge UAE VAT. The sector imports specialist services at scale: drilling and seismic contractors, foreign engineering, technical licences, and management charges from non-resident parents. Each is an imported service on which the UAE operator self-accounts under Article 48 of the VAT Law. The mechanism exists because a non-resident supplier cannot be expected to register and charge UAE VAT; the law moves the obligation to the UAE recipient, who knows its own recovery position. The practical routine is a purchase-ledger review each period: every foreign supplier invoice tested for UAE consumption, the self-accounted VAT declared, and the recovery claimed where the use is taxable.

The table sets out the sector's typical imported services. In each case the foreign invoice correctly shows no UAE VAT, and the UAE recipient declares 5% output tax and recovers it as input tax to the extent the services are used for taxable supplies.

# Imported services versus imported goods

The reverse charge applies to imported services. Imported goods are taxed differently: VAT is paid at customs on the import, calculated on the customs value, and recovered as input tax. Producers, refiners, distributors, service companies and traders must keep the two apart, because equipment imported through customs follows the goods route, while the service purchases follow Article 48.

# Accounting for the reverse charge on the return

The self-accounted VAT is declared as output tax for the period, and the same amount is claimed as input tax where the statutory conditions are met, which for most producers, refiners, distributors, service companies and traders means full recovery against taxable outputs. The net cash effect is nil where recovery is full, but the declaration is still required: omitting both legs understates both output tax and input tax. Where the imported services are used partly for exempt supplies, the recovered portion follows the apportionment percentage, and the workings should show the split.

# Reverse charge and the registration threshold

Imported services received count toward the AED 375,000 mandatory threshold and the AED 187,500 voluntary threshold under Article 19 of the VAT Law. Producers, refiners, distributors, service companies and traders with heavy foreign purchasing can be registrable on imports alone, before their own turnover would suggest it.

# Reverse charge on intra-group oil & gas services

Management fees, secondments, shared-service charges and royalties between group companies are supplies like any other, and where the provider is non-resident the UAE recipient self-accounts under Article 48. For producers, refiners, distributors, service companies and traders in international groups, these charges are often the largest reverse-charge line on the return, and informal or undocumented arrangements do not remove the obligation; they only remove the paperwork that proves the value.

# Timing and valuing the reverse charge in oil & gas

The reverse charge is accounted for at the date of supply of the imported service, following the same date-of-supply rules as domestic supplies, and on the full consideration in UAE dirhams, converting foreign currency at the appropriate rate with the rate documented. For producers, refiners, distributors, service companies and traders with retainer and subscription imports, each billing period creates its own liability; annualising or estimating the reverse charge across periods mistimes it. Keep the foreign contracts, invoices and payment proof with the workings.
