Oil and Gas VAT Compliance: Reverse Charge in the UAE Energy Sector

UAE oil and gas VAT: domestic reverse charge on hydrocarbons, imported services and EPC contracts, cross-border flows and sector compliance.

oil gas vat uae reverse charge

UAE oil and gas businesses live with the reverse charge daily: domestic B2B supplies of crude oil, refined oil and natural gas are reverse-charged at 5% by the buyer, while imported services — EPC contractors, foreign consultants, equipment suppliers' services — trigger the recipient's self-accounting. Cross-border flows need per-transaction place-of-supply analysis. Sector compliance means product classification, counterparty verification, and reconciliation of massive volumes to the VAT return.

# The hydrocarbon reverse charge in sector context

Upstream producers, refiners, traders and distributors move crude, products and gas between each other constantly. Every domestic B2B supply within the specified categories is reverse-charged: the seller invoices without VAT, the buyer self-accounts for 5% and recovers it where entitled. At sector volumes, the VAT return's reverse charge lines are among the largest in the country.

Product classification is the sector's core VAT control: each stream — crude grades, condensates, LPG, LNG, refined products, gas at various processing stages — mapped to the legislative categories. New streams and blended products go through classification before trading.

Counterparty verification must be systematic: reverse-charging requires a registered recipient, and manual TRN checks do not scale to trading volumes. Integrate verification into the trading and settlement systems.

# EPC contracts and foreign services

Major projects engage foreign EPC contractors, licensors, designers and specialist service providers. Where the place of supply is the UAE, the UAE project company self-accounts for 5% on these services under the imported-services reverse charge — on contract values that can run to billions of dirhams.

EPC contracts need the VAT analysis built into the commercial terms: the services versus goods elements, the place of supply of each, who self-accounts, and how the contract price treats the VAT. A contract silent on VAT leaves the project company with an unbudgeted 5% self-accounting on the full foreign services value.

Ongoing operations import services continuously: maintenance contractors, technical services, seconded personnel, software and data. Each needs its standing classification and its place in the monthly reverse charge reconciliation.

# Cross-border and trading flows

Hydrocarbon imports attract import VAT through the return on the customs value — per cargo, the figure is large and must be right first time. Exports are zero-rated with the standard export evidence, systematised per cargo under the long-term contracts that dominate the sector.

International trading — buying and selling cargoes without UAE delivery — needs each supply's place-of-supply analysis: the reverse charge applies to domestic B2B supplies, not to supplies outside the scope of UAE VAT. Trading desks must distinguish the two in real time.

Transfer pricing and VAT valuation interact on related-party cross-border flows: the customs value, the VAT base and the transfer price must be reconcilable. The three are tested by different authorities asking the same underlying question — what were the goods really worth?

# Sector compliance architecture

Build the VAT into the trading and ERP systems: product master data carrying the VAT classification, counterparty master data carrying the verified TRN status, and automated reverse charge postings from the transaction type. Manual VAT handling does not survive sector volumes.

Reconcile monthly: traded volumes and values to the reverse charge declared, import declarations to import VAT, export cargoes to zero-rated exports evidenced. The reconciliation is the audit defence — the FTA's data analytics compare the sector's reporting across participants.

Retain the full file for five years: contracts, nominations, bills of lading, classifications, TRN verifications, foreign service files and return workings. And review the legislation watch: hydrocarbon VAT rules evolve, and the sector's treatment must evolve with them.

# Trading desk VAT: the daily routine

An oil trading desk's VAT routine runs at market tempo. Pre-trade: the product master confirms the stream's classification — reverse-charged or standard-rated — and the counterparty master confirms the TRN status. The deal cannot be booked without both: the system blocks unclassified products and unverified counterparties.

Post-trade: the confirmation feeds the VAT workings automatically — reverse charge output tax computed on the deal value, the reporting category assigned. End of day: the desk's traded volumes reconcile to the workings' postings, with breaks investigated before the next day's trading.

Month-end: the full reconciliation — nominations to imports declared, domestic trades to reverse charge reported, exports to evidence held — signed off before the return is filed. The routine's premise is that at sector volumes, VAT cannot be a back-office afterthought: it must be in the trading system, the deal flow and the daily close. The desks that run this routine treat VAT as market infrastructure; the FTA's energy desk expects nothing less.

FAQ Answers to the questions people actually ask

Frequently asked questions

How does the reverse charge work in oil and gas?

Domestic B2B supplies of crude oil, refined oil and natural gas are reverse-charged: the seller invoices without VAT and the registered buyer self-accounts for 5%, recovering it where entitled. Block unclassified products and unverified counterparties in the trading system: the deal should not book without both.

Do EPC contracts trigger the reverse charge?

Where the contractor is foreign and the place of supply is the UAE, yes — the UAE project company self-accounts for 5% on the services under the imported-services reverse charge. Build it into the contract terms. Reconcile traded volumes to the workings daily and to the return monthly: breaks investigated before the next trading day.

How are hydrocarbon imports and exports treated?

Imports: import VAT through the return on the customs value. Exports: zero-rated with the standard export evidence, systematised per cargo. Model centralised procurement structures before implementing: concentration can create a partially-exempt cost centre.

What does sector VAT compliance require?

Product classification in master data, systematic TRN verification, automated postings, monthly reconciliation of volumes to the return, and five-year records. Keep the five-year file per cargo and contract: the sector's scale means the FTA's review standard matches it.
