QIF Exemption Application: How Investment Funds Apply to the FTA
How an investment fund applies for Qualifying Investment Fund status: EmaraTax registration, the 90-business-day window and the evidence pack.
qif application fta
A fund claims QIF status on EmaraTax in two steps: register for corporate tax first, then apply. Under FTA Decision No. 15 of 2026 the application is due within 90 business days of the Tax Period end. The file must prove every condition — regulatory oversight, investor access, investment-business purpose, the 5% ancillary cap, manager control and investor transparency — with evidence tied to the audited accounts. Meeting the conditions without applying gives no exemption.

# Register first, then apply
FTA Decision No. 15 of 2026 replaced Decision No. 7 of 2023 and fixed the sequence: the fund first becomes a registered person in the tax system, then applies for exempt status. An application without prior registration is procedurally defective.
Registration captures the fund's identity, Tax Period and contact particulars on EmaraTax and produces the Tax Registration Number. Complete it early in the window — the 90 business days run from the Tax Period end regardless of when registration happens.
Funds already registered under the old framework do not re-register; they move straight to the application step under the new decision's timelines.
# The evidence pack condition by condition
Regulatory oversight: the fund's or manager's licence from the UAE or recognised foreign authority, plus evidence the licence is current and covers the activity.
Investor access: listing particulars from the Recognised Stock Exchange, or offering documents, marketing materials and distribution records proving interests were marketed and made available sufficiently widely.
Investment business and the 5% cap: a revenue analysis for the financial year showing principal activity is Investment Business and ancillary revenue within 5% of total revenue, tied to the audited accounts.
Manager control and transparency: the investment management agreement showing genuine manager discretion, governance documents, and specimens of the investor information packs used to meet the transparency obligation.
| Condition | Key evidence |
|---|---|
| Regulatory oversight | Current fund/manager licence |
| Investor access | Listing particulars or marketing/distribution records |
| Investment business purpose | Offering documents, investment policy |
| 5% ancillary cap | Revenue analysis tied to audited accounts |
| No investor day-to-day control | Management agreement, governance records |
| Investor transparency | Investor information packs |
# Timing and the transition
Decision No. 15 of 2026 applies to Tax Periods commencing on or after 1 June 2023 but only to applications submitted on or after 15 September 2026. Earlier applications continue under Decision No. 7 of 2023 — leave in-flight applications alone unless advised otherwise.
The 90-business-day window is the hard outer limit for new applications. Funds with December year-ends should diary the deadline as soon as the period closes, not when the audit completes.
A missed window can cost the exemption for the period. Unlike the old framework's vaguer timing, the new decision sets a measurable deadline — treat it like a filing deadline, with the same escalation if it is at risk.
# After the application: approval, queries and renewal
The FTA may query the application — typically on the 5% computation, the wide-marketing evidence or the manager-discretion documents. Respond within the FTA's timelines with primary documents, not assertions.
Approval confirms QIF status for the relevant period. It does not grandfather the fund against future condition failures: each Tax Period needs its conditions re-verified, and the application cycle repeats.
If the fund's facts change — new share class, new manager, new activity line — assess the QIF conditions before the change takes effect, not at the next application. Prevention is cheaper than repair.

Frequently asked questions
How does a fund apply for QIF status?
On EmaraTax in two steps: register for corporate tax first, then apply for the exemption. Under FTA Decision No. 15 of 2026 the application is due within 90 business days of the end of the relevant Tax Period, with evidence proving every Article 10 and Cabinet Decision condition.
What is the QIF application deadline?
Within 90 business days of the end of the relevant Tax Period. The deadline comes from FTA Decision No. 15 of 2026, effective 15 September 2026, and applies to applications submitted on or after that date. Registration must come first, so sequence the two steps with the deadline in mind.
What evidence does the FTA expect?
The licence proving regulatory oversight, listing or marketing evidence proving investor access, offering documents and a revenue analysis proving the investment-business purpose and the 5% ancillary cap, the management agreement proving manager discretion, and investor information packs proving transparency — all tied to the audited accounts.
Can a fund reapply if conditions change mid-year?
The conditions are tested continuously, so a mid-year change — new manager, new activity, ownership shift — should be assessed immediately against the QIF test. The application cycle runs per Tax Period, but waiting until the next application to address a known breach risks the status for the whole period.
