Voluntary Disclosure Penalty Relief for Corporate Tax in the UAE
Disclosing a corporate tax error voluntarily cuts the penalty to 1% per month; waiting to be found adds a fixed 15%. The arithmetic, with examples.
voluntary disclosure penalty relief uae
A voluntary disclosure replaces the fixed 15 percent penalty for non-disclosure with a charge of 1 percent of the tax difference per month from the day after the original due date. Failing to disclose before an audit notification means the fixed 15 percent plus the same monthly 1 percent. On a AED 50,000 error discovered 30 months after the due date, disclosure costs about AED 15,000 in penalties versus about AED 22,500 if found.

# The two prices for the same error
The penalty table prices every tax-difference error twice. Item 10 is the price of confession: 1 percent of the tax difference for each month or part month, measured from the day after the original return's due date to the date the voluntary disclosure is submitted. Item 11 is the price of being found: a fixed 15 percent of the tax difference plus the same 1 percent per month, applied where the taxpayer failed to disclose before being notified of a tax audit.
The monthly component is identical in both items; it accrues with time regardless of behaviour. The fixed 15 percent is the pure surcharge on silence. That design makes the economics unambiguous: for any given error of any given age, disclosing is always cheaper than being found, and the gap never closes with time.
Both items measure months as months or part months, so an error disclosed 30 months and one day after the due date accrues 31 months of the 1 percent. The monthly clock, like the filing penalty clock, does not pro-rate.
# Worked examples
Take a AED 50,000 underpayment. Discovered and disclosed 12 months after the return's due date, the penalty is 12 percent: AED 6,000. Found by the Authority instead, it is 15 percent fixed plus 12 percent monthly: AED 13,500. The disclosure saves AED 7,500.
Age the error to 30 months. Disclosed: 30 percent, AED 15,000. Found: 15 percent plus 30 percent, AED 22,500. The saving is still exactly the fixed 15 percent, AED 7,500, because the monthly component accrues identically in both scenarios. The lesson is that delay costs the same monthly charge whether you disclose or not; what disclosure buys is the removal of the fixed surcharge.
Now vary the size. On a AED 500,000 underpayment at 30 months, disclosed costs AED 150,000 and found costs AED 225,000: a AED 75,000 saving for the same paperwork. The larger the error, the more the disclosure is worth, which is the opposite of the intuition that big errors are scarier to disclose.
| Tax difference | Age (months) | Disclosed (item 10) | Found (item 11) | Saving |
|---|---|---|---|---|
| AED 50,000 | 12 | AED 6,000 | AED 13,500 | AED 7,500 |
| AED 50,000 | 30 | AED 15,000 | AED 22,500 | AED 7,500 |
| AED 500,000 | 30 | AED 150,000 | AED 225,000 | AED 75,000 |
| AED 100,000 | 6 | AED 6,000 | AED 21,000 | AED 15,000 |
# Maximising the relief in practice
Three behaviours maximise what disclosure saves. First, disclose early in the error's life, because the monthly 1 percent is the one component you cannot avoid and it grows every month. An error disclosed in month 2 costs 2 percent; the same error disclosed in month 20 costs 20 percent. The fixed 15 percent saving is constant, but the total bill is not.
Second, disclose before any audit notification, because the notification is the event that locks in the 15 percent. Where an audit of any kind is rumoured or expected, the expected-value calculation favours immediate disclosure of known errors. Third, pay within the 20-business-day payment window after submission, because the disclosed tax otherwise starts accruing the 14 percent per annum item 8 charge on top of the disclosure penalties.
None of this requires the error to be fully quantified to the dirham before disclosing. Disclose the best-computed figures promptly and refine them through the review process; the submission date, which stops nothing but starts the payment window and evidences promptness, matters more than perfect precision on day one.
Partial disclosure still helps
Disclosing the errors you have quantified while still investigating others is better than waiting for a complete file. Each disclosed error gets the item 10 treatment from its disclosure date; the undisclosed ones keep accruing toward item 11.

Frequently asked questions
How much penalty does voluntary disclosure save in the UAE?
It removes the fixed 15 percent of the tax difference that applies when the FTA finds the error first. The monthly 1 percent accrues in both cases. On a AED 50,000 error, disclosure saves AED 7,500 regardless of the error's age; on larger errors the saving scales proportionally.
Does voluntary disclosure eliminate all penalties?
No. The monthly 1 percent of the tax difference from the day after the original due date still applies under item 10, plus the flat AED 500 for the incorrect return under item 9. What disclosure eliminates is the fixed 15 percent surcharge under item 11 and the risk of worse treatment at audit.
Should I disclose an error I have not fully quantified yet?
Yes, disclose promptly with your best-computed figures and refine them during the review. The submission date evidences prompt action and starts the payment window; waiting for perfect precision only adds monthly 1 percent accrual and risks an audit notification locking in the 15 percent.
