Precedent Value of Tax Judgments

tax precedents uae
Published tax judgments guide — but the UAE is a civil law system, and each case turns on its facts and the law as it stood. Use judgments for the legal reasoning: how courts interpret the finality threshold, what 'business days' means in practice, how the 50% security is applied. Do not treat a favourable judgment on different facts as a guarantee — tribunals distinguish cases readily, and the law evolves (FDL 17/2025 changed several provisions).

# The court appeal: how you get here
Published tax judgments guide — but the UAE is a civil law system, and each case turns on its facts and the law as it stood.
Article 36 gives both the Authority and the taxpayer 40 business days from notification of the Committee's decision to appeal to the competent court, in two cases: objecting to the Committee's decision in whole or in part, or where the Committee issued no decision on a duly submitted objection. The court will rule the appeal inadmissible unless the full tax is paid and at least 50% of the administrative penalties is settled in cash or secured by an approved bank guarantee — Article 36(2).
# What court decisions mean for your case: the appeal

Do not treat a favourable judgment on different facts as a guarantee — tribunals distinguish cases readily, and the law evolves (FDL 17/2025 changed several provisions).
Practicalities
A judgment on the Article 36(2) security computation: cite its reasoning on the computation method, but verify the law has not since changed and the facts align. Reasoning travels; outcomes do not always.
# What the court can do, and what follows
The most valuable precedent is recent, on-point, and on current law. Dated judgments on amended provisions mislead — check the law's current text before relying on any decision.

# Preparing the court appeal: what changes at this stage
Court is a different forum from everything before it, and the preparation must reflect that. Four things change:
The admissibility conditions are strict and checked first
Before the court reaches your arguments, it checks Article 36(2): was the appeal filed within 40 business days of the Committee's notification, is the full tax paid, and is at least 50% of the penalties settled in cash or secured by an approved bank guarantee? Fail any one and the appeal is inadmissible. Arrange the guarantee early — banks take weeks — and verify the tax payment has allocated correctly. The pleadings must be litigation-grade
Committee papers do not suffice. The court expects formal pleadings: the facts, the legal grounds with article references, and the remedy sought, each exhibit formally referenced and numbered. Engage litigation counsel — tax advisers who shone at reconsideration may not be advocates. The grounds should be reframed for a judge, not a committee: tighter, more formal, with the evidence chain explicit.
New evidence rules apply
Courts apply evidential standards the earlier forums do not. Ensure translations are certified, documents are properly exhibited, and the chain of custody is clear. Evidence the Committee saw informally must be re-presented formally. If new evidence emerged after the Committee stage, take advice on its admissibility before relying on it.
Settlement remains possible
Even at the court stage, settlement can be the rational outcome — particularly where the amount in dispute is modest against the cost of litigation, the guarantee tie-up, and management time. Assess settlement against the strength of the surviving grounds honestly, and keep the Article 50 instalment track in mind for whatever balance remains. A well-prepared appeal settles better than a weak one. Discuss settlement authority with the decision-makers before the hearing, not during it.

Frequently asked questions
Do I need a lawyer for the court appeal?
Yes, in practice — court procedure, evidence rules, and advocacy before the competent court need litigation counsel. Your tax agent or adviser works alongside counsel on the technical merits. Engage counsel in week 1 of the 40-day window, not week 6.
What does the 50%-of-penalties security actually cost?
Either the cash itself (paid to the FTA) or a bank guarantee's arrangement fees and collateral — for large penalties, the guarantee is usually cheaper than locking up cash, but it takes 2–4 weeks to arrange. Start in week 1; the security must exist within the 40-day window.
Are TDRC decisions published as precedents?
Not systematically as court judgments are — which limits their precedential use. Court judgments (including the Federal Supreme Court's tax rulings) are the citable authorities. Build the appeal's legal argument on the statute first, judgments second.
