Record-Keeping for Zone Transactions Going Forward

The zone file standard: status evidence, movement records, and treatment analysis per transaction, retained five years. The complete method, step by step.

record-keeping for zone transactions going forward

Hold every zone transaction to a file standard: the zone's status evidence at the transaction date, the movement records proving the goods' path, and the treatment analysis showing why the VAT and excise positions follow — per transaction, retained five years under Article 3 of Cabinet Decision No. 74 of 2023. Build the file as the transaction happens, not at disclosure time: contemporaneous records prove, reconstructions explain.

# What the rules say

The disclosure file: discovery memo, zone-status evidence per period (designation in force at the time), movement records per transaction, the VAT and excise recomputations, contracts describing the supply chains, EmaraTax references, and payment proof — five years. Zone files are evidence-heavy by nature; a file that proves both status and movement per transaction is a file that closes. Anything less invites the FTA to disbelieve the zone treatment entirely.

# How to handle it in practice

The movement pillar is what the FTA actually tests: warehouse records, transport documents, gate passes, and operator records showing the goods entered, moved within, or left the zone as claimed. Treatment without movement evidence fails — the classic pattern is invoices describing zone supplies with no corroborating movement at all. Build the movement file per transaction from contemporaneous records; reconstructed narratives written for the disclosure carry little weight against missing primary evidence.

# The five-year window behind every disclosure

Errors do not expire quickly. Tax records must be kept for five years after the end of the relevant tax period, and the FTA's assessment powers run on a similar horizon — longer where evasion is suspected. Practically, this means a voluntary disclosure should sweep every affected period inside the window, not just the most recent one: correcting 2025 while leaving the same 2023 error in place invites the FTA to find the older one itself, at which point the voluntary route is closed for that period. When you discover an error, ask whether the same mistake happened in earlier periods before you file — one complete disclosure covering all affected periods is cheaper and safer than a drip-feed of corrections.

# Documents to prepare before you open EmaraTax

A disclosure is only as strong as its evidence. Before starting the form, assemble the discovery memo (what was found, when, by whom), the original filed figures for each affected period, the corrected figures with a clear reconciliation between the two, and the source documents behind the correction — tax invoices, contracts, bank statements, import declarations, or payroll records as the error type requires. Keep everything for at least five years: Article 3 of Cabinet Decision No. 74 of 2023 (the Executive Regulation of the Tax Procedures Law) requires tax records to be retained for five years after the end of the relevant tax period (seven years for corporate tax under Article 56 of Federal Decree-Law No. 47 of 2022), and the FTA can ask to see the file behind any disclosure inside that window. A complete, dated file also protects you if the same error is ever questioned again — you can show exactly what was disclosed and when.

FAQ Answers to the questions people actually ask

Frequently asked questions

What is the minimum per-transaction zone file?

Status evidence (designation at transaction date), movement evidence (the goods' path documents), and the treatment note (why this VAT/excise position follows). Three items per transaction, filed systematically — the standard that makes verification a non-event. Build the evidence file before filing: verification tests the reconciliation line by line, and the complete file is what passes.

How do you correct a designated-zone tax error?

Through voluntary disclosure with two evidence pillars: the zone's designated status at the transaction date, and the goods-movement records proving the path taken. Reclassify each supply or movement with the zone analysis shown, sweep every affected period, and file within 20 business days of awareness.

What proves goods were in a designated zone?

Contemporaneous movement evidence — warehouse records, transport documents, gate passes, operator records — showing the goods entered, moved, or left as claimed. Invoices describing zone supplies without corroborating movement fail; the FTA tests movement, not paperwork. Keep the source documents that prove each corrected figure — the FTA verifies disclosures against primary records, not summaries.

Can zone status change retrospectively?

No — the disclosure must evidence the designation in force at each transaction date, not apply a current printout backwards. A transaction through an area that had lost its designation is a domestic supply regardless of what the invoice claims.

Do services in designated zones get outside-scope treatment?

Not as a blanket rule — certain supplies connected to zones are treated as inside the UAE, with services the prominent category. Confirm the current treatment per transaction type on tax.gov.ae; the blanket 'zone means outside scope' assumption is wrong in predictable places.

What if movement records are missing?

Reconstruct from every available source — operator records, transporter documents, customer receipts — and be transparent about gaps, taking professional advice. Treatment claimed with no movement evidence at all is the weakest possible disclosure position; build the best file the records allow.

Can one disclosure cover VAT and excise zone errors?

Prepare them as a coordinated correction — the movement evidence is shared, but each tax needs its own disclosure with its own recomputation. File both within the window so the figures agree across taxes. Build the evidence file before filing: verification tests the reconciliation line by line, and the complete file is what passes.

What is the deadline for zone-error disclosure?

Twenty business days from awareness where the understatement exceeds AED 10,000 (Article 10, Cabinet Decision No. 74 of 2023; an error of AED 10,000 or less is corrected in the next tax return instead) — awareness here being when the zone-treatment error was identified, often during a transaction review. Document it in the discovery memo and file by day 15. Calendar the 20-business-day deadline from the discovery memo date, and file by day 15 so the final days are buffer, not work time.
