Coordinating VAT and Excise Zone Corrections
The same zone movement error usually hits both taxes. Prepare coordinated disclosures sharing the movement evidence. The complete method, step by step.
coordinating vat and excise zone corrections
A zone movement error — a misreported transfer, a missed release — usually distorts both the VAT position and the excise position, because both taxes key off the same physical movement. Prepare the two disclosures as a coordinated correction sharing the movement evidence, with each tax's recomputation done independently from the shared facts.
Basis: UAE Federal Tax Authority
- Two pillars
- Zone status at transaction date + movement records
- FTA verification practice
- Deadline
- 20 business days from awareness
- Article 10, Federal Decree-Law No. 28 of 2022; Article 10, Cabinet Decision No. 74 of 2023
- Coordinate
- VAT and excise disclosures together
- Same movements hit both taxes
# What the rules say
Excise zone errors run in parallel: goods entering zones, transferred between zones, and released for local consumption each carry excise consequences, with the tax point typically on release into the UAE market. Missed release tax points are the standard excise zone finding — goods that left the zone's records without the excise being triggered. The disclosure recomputes with the release evidence: operator records, release authorisations, transport documents. Coordinate the VAT and excise corrections; the same movement error usually hits both.
# How to handle it in practice
The zone-status pillar comes first: was the area a designated zone at the transaction date, and did the specific transaction meet the qualifying conditions? Designations change, and conditional status depends on the operator meeting ongoing requirements. The disclosure must evidence the zone's status contemporaneously — the designation in force at the time, not a current printout applied backwards. A transaction routed through an area that lost its designation is a domestic supply, whatever the invoice says.
# Filing the disclosure in EmaraTax: the steps in order
Voluntary disclosures are filed inside EmaraTax, the FTA's online portal — there is no paper route. Menu labels in the portal change over time, so treat the exact button names below as a guide and follow what the portal shows on the day; the sequence and the information required do not change.
# Documents to prepare before you open EmaraTax
A disclosure is only as strong as its evidence. Before starting the form, assemble the discovery memo (what was found, when, by whom), the original filed figures for each affected period, the corrected figures with a clear reconciliation between the two, and the source documents behind the correction — tax invoices, contracts, bank statements, import declarations, or payroll records as the error type requires. Keep everything for at least five years: Article 3 of Cabinet Decision No. 74 of 2023 (the Executive Regulation of the Tax Procedures Law) requires tax records to be retained for five years after the end of the relevant tax period (seven years for corporate tax under Article 56 of Federal Decree-Law No. 47 of 2022), and the FTA can ask to see the file behind any disclosure inside that window. A complete, dated file also protects you if the same error is ever questioned again — you can show exactly what was disclosed and when.

Frequently asked questions
Do the two disclosures share a deadline?
Each has its own 20-business-day clock from awareness of its error — in practice the same discovery day. Run them as one workstream with one evidence file and two filings, both by day 15, so neither clock is the one that slips.
How do you correct a designated-zone tax error?
Through voluntary disclosure with two evidence pillars: the zone's designated status at the transaction date, and the goods-movement records proving the path taken. Reclassify each supply or movement with the zone analysis shown, sweep every affected period, and file within 20 business days of awareness.
What proves goods were in a designated zone?
Contemporaneous movement evidence — warehouse records, transport documents, gate passes, operator records — showing the goods entered, moved, or left as claimed. Invoices describing zone supplies without corroborating movement fail; the FTA tests movement, not paperwork. Keep the source documents that prove each corrected figure — the FTA verifies disclosures against primary records, not summaries.
Can zone status change retrospectively?
No — the disclosure must evidence the designation in force at each transaction date, not apply a current printout backwards. A transaction through an area that had lost its designation is a domestic supply regardless of what the invoice claims.
Do services in designated zones get outside-scope treatment?
Not as a blanket rule — certain supplies connected to zones are treated as inside the UAE, with services the prominent category. Confirm the current treatment per transaction type on tax.gov.ae; the blanket 'zone means outside scope' assumption is wrong in predictable places.
What if movement records are missing?
Reconstruct from every available source — operator records, transporter documents, customer receipts — and be transparent about gaps, taking professional advice. Treatment claimed with no movement evidence at all is the weakest possible disclosure position; build the best file the records allow.
Can one disclosure cover VAT and excise zone errors?
Prepare them as a coordinated correction — the movement evidence is shared, but each tax needs its own disclosure with its own recomputation. File both within the window so the figures agree across taxes. Build the evidence file before filing: verification tests the reconciliation line by line, and the complete file is what passes.
What is the deadline for zone-error disclosure?
Twenty business days from awareness where the understatement exceeds AED 10,000 (Article 10, Cabinet Decision No. 74 of 2023; an error of AED 10,000 or less is corrected in the next tax return instead) — awareness here being when the zone-treatment error was identified, often during a transaction review. Document it in the discovery memo and file by day 15. Calendar the 20-business-day deadline from the discovery memo date, and file by day 15 so the final days are buffer, not work time.
How do you prevent repeat zone errors?
A transaction-coding policy with zone-status verification built in — distinct system treatment for zone supplies, status checked per transaction, not a manual judgment per invoice. Document the policy fix in the disclosure file as remediation. Document the control fix with its effective date in the disclosure file — remediation is what keeps a closed matter closed.
