Advance Pricing Agreement Support in the UAE
The UAE has no published APA programme yet. Our APA-readiness support builds the benchmarking file, draft methodology and evidence pack you need today.
advance pricing agreement uae
An advance pricing agreement fixes your transfer pricing method with a tax authority in advance — but the UAE has published no APA programme you can apply to today. Our support is therefore readiness work: a functional analysis, multi-year benchmarking and a draft methodology file that strengthens your position now, supports a private clarification where one helps, and puts you first in line if a programme opens.

# The honest starting point: there is no UAE APA application to file
Most pages selling APA services in the UAE skip the first fact, so we will not: as of the guidance published to date, the UAE operates no published advance pricing agreement programme. There is no application form, no filing fee, no published procedure and no APA unit to apply to. Anyone offering to 'file your UAE APA' today is selling something that does not exist.
What does exist is the framework an APA would sit inside: the arm's length standard in Article 34 of the Corporate Tax Law, the FTA's Transfer Pricing Guide, a private clarification service for how the law applies to a specific case, and the mutual agreement procedure in the UAE's tax treaties. This service prepares your file to the standard an APA programme would demand, so the certainty available today is real — and if a programme opens, your application is already built.
# What an APA is, and why groups still prepare for one
An APA is a binding agreement between a taxpayer and one or more tax authorities that fixes the transfer pricing methodology for specified transactions over a set term. The taxpayer trades full transparency — its functional analysis, its data, its assumptions — for freedom from audit challenge on the covered transactions while the agreement holds and its critical assumptions remain true.
Unilateral, bilateral and multilateral
A unilateral APA binds one authority. A bilateral APA is agreed between two authorities through their competent authorities, so the same flow is accepted on both sides of the border; a multilateral APA extends that across several jurisdictions. The distinction matters because only the treaty-based forms remove double taxation risk entirely.
Term and rollback
In jurisdictions that run programmes, APAs typically run for three to five years, and some programmes allow the agreed method to be rolled back to earlier open years. The term is not open-ended: the agreement holds only while the critical assumptions recorded in it — market structure, functions, business model — continue to describe reality.
Why boards ask for one
The flows that justify an APA are the ones where a single adjustment would be material: intellectual property licences, principal and financing structures, and high-volume goods flows between group hubs. For those, 'we think the price is right' is a weaker board paper than a method agreed in advance — which is precisely why groups build the file before a programme exists to receive it.
# What APA-readiness support includes
Readiness work is not a placeholder. Each workstream produces the document an APA application would be built from, and every one of them earns its keep today — in an audit, in a clarification request, or in a board discussion about pricing risk.
| Workstream | What it produces | Why it matters now |
|---|---|---|
| Functional analysis refresh | An accurate delineation of each covered transaction | The foundation of both an APA file and an audit defence |
| Multi-year benchmarking | A tested arm's length range across several periods | Shows the method is stable, not selected for one convenient year |
| Draft methodology paper | The document an APA application would be built from | Converts directly into an application if a programme opens |
| Critical assumptions log | The conditions your pricing depends on, recorded explicitly | Mirrors how APAs define their own validity and limits |
| Treaty and MAP review | A map of treaty routes for the group's flows | Identifies your live route to cross-border certainty today |
# The certainty routes that exist in the UAE today
Until an APA programme exists, certainty in the UAE is assembled from three working parts. A private clarification asks the FTA how the legislation applies to the case you describe; it answers on the facts you present, so the quality of the submission decides its value — and it is a reading of the law for a defined case, not a method fixed for future years.
Second, contemporaneous documentation: a master file, local file and benchmarking set built as the transactions happen is the closest substitute for advance agreement, because it leaves an auditor nothing to reconstruct. Third, the mutual agreement procedure: where the same profit is taxed in two jurisdictions, the UAE's double tax treaties provide a competent-authority channel to relieve the double taxation. It is slower than an APA and resolves the past rather than fixing the future — but it is real, and it is available now.
# How we build your APA-ready file
The build follows the same order an APA examiner would read it, so nothing has to be reworked if a programme opens or the FTA asks questions first.
-
Scope the covered transactions
We identify the flows whose pricing carries material risk — intellectual property, financing, principal trading, head-office services — and fix the periods and entities the file will cover.
-
Run the functional analysis
Interviews and agreements produce an accurate delineation of each transaction: functions, assets, risks, and the contractual terms that allocate them.
-
Benchmark across multiple years
We build the comparable set and test your method against several periods of data, so the file demonstrates a stable method rather than a favourable year.
-
Draft the methodology and assumptions
The methodology paper and critical assumptions log are drafted in the form an APA application would take, with the annual compliance reporting an APA would require anticipated.
-
Decide the live route
We conclude with a route decision: seek a private clarification on a defined point, prepare MAP readiness for a live dispute, or hold the completed file against a future programme — with the reasoning recorded.
# Who should prepare now — and what we cannot do
Prepare now if your group routes material value through the UAE: intellectual property licensed into or out of the Emirates, intra-group financing of any size, a UAE principal or hub in a wider supply chain, or a first FTA transfer pricing enquiry already on the file. In each case the readiness file is also your audit file, so the work is never wasted.
What we cannot do, stated as plainly as the rest of this page: we cannot obtain an advance pricing agreement the FTA does not currently offer, cannot guarantee the outcome of a clarification request, and cannot promise that a future programme will accept a method we draft. Formal representation before the FTA belongs to a registered tax agent or legal representative where the law requires one; we prepare the technical case and work alongside yours. If a programme is announced, clients holding a completed file will be ready to file while others are still scoping — that, and a stronger position today, is the honest offer.

Frequently asked questions
Can I apply for an advance pricing agreement in the UAE today?
No. As of the guidance published to date, the UAE has no published APA programme, application route or fee schedule, and the FTA has not opened one to apply to. The correct move today is readiness: build the functional analysis, benchmarking and methodology file to application standard, use the certainty routes that do exist, and monitor FTA announcements so you can move first if a programme is introduced.
What is the difference between a unilateral and a bilateral APA?
A unilateral APA is agreed with one tax authority and binds only that authority. A bilateral APA is negotiated between two authorities through their competent authorities under a tax treaty, so both ends of the same transaction accept the method — which is what actually removes double taxation on the covered flow. A multilateral APA extends the same approach across several jurisdictions. The treaty channel a bilateral APA uses is the mutual agreement procedure.
What is a private clarification, and how far does it go?
A private clarification is an FTA service that answers how the tax legislation applies to the specific case an applicant describes. Its value depends entirely on the accuracy and completeness of the facts presented: change the facts and the answer may not follow. It is not an APA — it does not fix a transfer pricing method for future years — but on a defined legal question it is the closest certainty instrument the UAE currently offers.
How long does an APA usually last in countries that offer one?
Typically three to five years, in the jurisdictions that run programmes, sometimes with the option to roll the agreed method back to earlier open years. The agreement remains valid only while its critical assumptions hold; a fundamental change in the business ends or reopens it. The UAE has no term to quote because it has no programme yet — our readiness files are built across the same multi-year horizon.
Will an APA-ready file help if the FTA audits us first?
Yes — it is substantially the same file. The functional analysis, multi-year benchmarking, methodology paper and assumptions log that an APA application would present are exactly what an audit response needs, and master and local files must in any event be producible within 30 days of an FTA request under Article 55 of the Corporate Tax Law. Groups that prepare for certainty are, by the same work, prepared for challenge.
Does my group qualify for the mutual agreement procedure?
MAP is available under the UAE's double tax treaties where the same income is taxed, or risks being taxed, in both jurisdictions contrary to the treaty. Availability and procedure depend on the specific treaty with the other state, and requests go to the competent authority the treaty names. We map the route for your group's flows as part of readiness work, including which years remain open under each treaty's time limits.
